.......................XX NOTICE OF AVAILABILITY OF DRAFT PROPOSED RULE ON GENERALLY LICENSED DEVICES The Commission plans to issue in the near future a proposed rule that would require certain general licensees to respond to NRC requests for information. It is to be used to initiate a registration program for those devices for which enhanced regulatory oversight was recommended in NUREG-1551," Final Report of the NRC-Agreement State Working Group to Evaluate Control and Accountability of Licensed Devices." This first rule will not require compatibility of Agreement State requirements. Agreement State compatibility issues will be addressed in a more comprehensive follow-on rule on improving the accountability for generally licensed devices. NRC has established a working group to develop the rule which includes representatives from the States of Maryland and New Jersey.
On or about the date of this letter, a draft of this more comprehensive proposed rule and a summary of its provisions to aid in the review will be posted on the Technical Conferencing Forum (TCF) for your review and comment. The TCF can be accessed directly at
<http /techconf.llnl. gov /index.html>. Please note that an updated list of user identifications (to

reflect changes in users) and passwords (which remain unchanged from their initial issuance in 1995) was previously transmitted to all Agreement States in Agreement States letter I

A presentation will be made on this rulemaking on October 30,1998, at the All Agreement States Meeting. We request that the States be prepared to discuss the draft rule language and j
compatibility issues and, if possible, to provide written comments at the meeting. This is to i
afford the States the opportunity to provide input at an early stage of development of the

proposed rule. The NRC staff will discuss concerns and answer questions at the meeting. The proposed rule will be distributed to the Agreement States again approximately mid-December i
for formal review and comment.
