ENCLOSURE 1 NOTICE OF VIOLATION Tennessee Valley Authority Docket Nos. 50-327 and 50-328 Sequoyah Units 1 and 2 License Nos. OPR-77 and DPR-79 During the Nuclear Regulatory Commission (NRC) inspection conducted from March 6, 1988 to April 4, 1988, violations of NRC requirements were identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR'2, Appendix C (1988), the violations are listed below:

A. 10 CFR 50, Appendix B, Criterion V states that activities atfecting quality shall be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances and shall be accomplished in accordance with these instructions, procedures, or drawings.

Drawings 47W470-4, and 478473 sheets 2, 5, and 6 establish the proper installation of penetration seals.

Contrary to the above, prior to March 6,1988,16 point crane wall penetrations were not sealed in accordance with these design drawings.

This a Severity Level IV violation (Supplement I)

8. Technical Specification 6.8.1 requires that written procedures be established, implemented, and maintained for surveillance and testing activities of safety-related equipment, Fire Protection Program implementation, and procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978. Surveillance Instruction 233.1, "Visual Inspections of Penetration Fire Barriers - Mechanical System 302 (Penetrations)" implements required periodic visual surveillance of fire barriers.

Contrary to the above, prior to March 6, 1988, the licensee failed to have an adequate orocedure for periodic inspections of the shield building nenetration ' ire barrier foam seals. Fabric boot sleeves were installed during origial plant construction on 53 of these penetrations, for hydraulic cons:de ations, making the foam fire barriers inaccessible.

Surveillance Instruction (SI) 233.1, "Visual Inspections of Penetration Fire Barriers-Mechanical System 302 (penetrations)" and its pradecessors did not require removal of these sleeves to permit fire barrier inspection or reauire inspection n' +.he barrier from the opoosite side of the wall.

As a result, the licensee ird not met the requirements of f.S. 4.7.12 for visual inspection of fire barrier .u cis since plant licensing.

Pursuant to the provisions of 10 CFR 2.201, Tennessee Valley Autnority is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Director, Of fice of Special Projects and a copy to the NRC Resident Inspector, Sequoyah, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a "Reply to a Notice of Violation" and.should include for each violation: (1) admission or

. denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid furtrier violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
