Ref: (1) Your letter dated May 9,1988 forwarding a NRC Form 241 (2) Your letter dated May 10, 1988 forwarding a NRC Form 241 In Reference (1) yotf reguest approval for disposal of licensed material at sea.
Section 150.20 of 10 CFR, which provides the General License under which Agreement State licensees perform licensed activities in non-Agreement States and offshore waters, provides in Paragraph (b)b(y any means except transfer to2) that any prohibited from disposal of licensed material will not approve a request for disposal at sea unless(b)he applicant shows that an authorized recipient.
In addition, 10 CFR 20.302 states that the NRC t
sea disposal offers less harm to man and the environment than than other practical alternative methods of disposal.
Your request for disposal of radio-active material at sea is hereby denied.

Section 150.20 provides a General License for Agreement State licensees to parform activities in non-Agreement States which are authorized in the Agreement State license [10 CFR 150.20(a)].
Your license does not authorize studies where radioactive material is deliber-ately released into the environment. Therefore, the proposed study is not permitted under the General License in Section 150.20(a).
The proposed study might be permissible under an NRC license authorizing a specific activity at a specific location.
If you wish to pursue this avenue, you must file an application for an NRC license with this office.
In accordance with Section 2.790 of the NRC's "Rules of Practice " Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the Public Document Room.
