NRC STAFF MOTION FOR EXTENSION OF TIME WITIIIN WHICH TO RESPOND TO APPLICANTS' MOTIONS FOR
SUMMARY
DISPOSITION The A pplicants have filed eight motions for summary disposition regarding emergency planning contentions admitted by the Licensing Board for litigation in this proceeding.
The NRC staff has responded to four of these motions.
The NRC Staff's responses as to the remaining four motions are presently due on March 24, 26, 31 and 31, 1986.
The Staff, for the reasons set out herein, asks that its time to respond to these motions be extended to April 15, 1986.
The NRC Staff's reply to the four motions it has responded to and its reply to the motions upon which it has yet to reply are premised on affidavits of the Federal Emergency Management Agency's (FEMA)
Emergency Management Program Specialist, Cheryl L.
Stovall, the FEMA reviewer charged with evaluating the Vogtle plant's off-site emergency plans for adequacy.
See 10 C.F.R. I 50.4"(a)(2).
Ms. Stovall, who is most familiar with these plans, has recently been hospitalized with pneumonia.
Thus, the Staff is unable to reply to the four outstanding DESIGNATED ORIGINAL U SO -7 M-D 24 Certified By PDR
r motions in the time provided in 10 C.F.R.
I 2.749.
Staff counsel has been informed by the FEMA Regional Office in Atlanta, Georgia, that the prognosis of Ms. Stovall's illness is that she will return to work in sufficient time for the Staff's answers to the four motions to which it has not yet replied to be submitted by April 15, 1986.
Accordingly, the Staff moves for an extension of time to and including April 15, 1986, within which to respond to the four remaining motions for summary disposition.
The parties to this proceeding have previously indicated, in a prehearing conference, that they would have no objection to a request for en extension of time (see Tr. 210).
