COMMENTS ON H.R. 6212

'The Chairman of the House Committee on Interstate and Foreign Com-merce has requested the Commission's comments on H.R. 6212, a bill i]

which would encourage States to establish disposal facilities for low-level waste by requiring the termination of NRC licenses in those states which do not provide for disposal of low-level-waste generated in their borders.

H.R. 6212 would also authorize States to enter into compacts to establish disposal facilities; and author-J ize the NRC to reimburse States for pre-construction ac,tivities i

related to the development of low-level waste facilities.

I would appreciate your_ comments on this bill-by February 8, 1980.

To amend the Atomic Energy Act of 1954 to require each State to provide for the disposal of low-level radioactive waste generated within that State, to authorize States to enter into agreements or compacts with other States for the establishment of regional disposal sites for low-level radioac-tive waste, and to provide financial assistance to the States in which such sites are located, and for other purposes.

1 Be it enacted by the Senate and House of Representa-2 tives of the United States of America in Congress assembled, 3 That after the date five years following the date of the enact-

2 1 ment of this Act, no license or permit under the Atomic En-2 ergy Act of 1954 for any facility or activity which may resuit 3 in the the generation of low-level radioactive waste shall con-4 tinue in force and effect, and no such license or permit may 5 be issued or renewed, unless the State in which the licensee 6 or permittee is located has taken such steps as may be neces-7 sary to assure the safe storage and disposal of all low-level 8 radioactive waste generated in that State. Such steps may

9 include the establishment in the State or in any other State g

10 of a facility for low-level radioactive waste storage and dis-11 posal constructed and operated by any governmental or non-12 governmental entity licensed by the Nuclear Regulatory 13 Commission for such purposes pursuant to the applicable pro-14 visions of the Atomic Energy Act of 1954.

15 SEC. 2. Each State in which low-level radioactive waste t

16 is generated is hereby authorized to enter into such agree-17 ments and compacts with other States as may be necessary g

18 to establish facilities for the disposal of such low-level radio-19 active waste.

20 SEC. 3. (a) The Nuclear Regulatory Commission is au-21 thorized to provide financial assistance to each State within 22 which there is located a facility for the disposal of low-level 23 radioactive waste. Such assistance shall be used only to reim-24 burse such State for costs incurred by the State in the pre-

3 I construction activities involved in the establishment of such

'2 facility.

3 (b) Any facility for which assistance is provided under 4 this section shall require the payment of fees for the receipt 5.of low-level radioactive waste to be stored or disposed of at 6 such facility. The fees shall be established at the level neces-7 sary to amortize the full costs of construction and operation 8 of tiie facility over its usefullife.

9 (c) There is authorized to be appropriated for purposes 10 of this section not more than $100,000,000 for fiscal years 11 beginning after October 1,1980.

12 SEc 4. For purposes of this Act, the term " low-level 13 radioactive waste" means any byproduct material (as defined 14 in subsection e. (1)) which contains less than ten nanocuries 15 of transuranic contaminants per gram of material or any such 16 byproduct material which is free of transuranic contaminants Q

17 but which the Commission determines, under rules promul-18 gated by it, to have a low, but potentially hazardous, concen-19 tration or quantity of radionuclides.
