Dear Chairman Zech:

I am sure you are aware of the recent federal appeals court decision which recognizes the right of the Nuclear Regulatory

ommission to accept emergency preparedness plans submitted by nuclear power plant owners, our judiciary branch has the obligation to interpret our laws and rule appropriately, and I accept their decision.

Nevertheless, my primary concern continues to be the adequacy of any evacuation plan the Seabrook Nuclear Power Plant owners may prepare. The population density and the geographical environment of the Massachusetts communities surrounding the plant makes it impossible to sufficiently provide for the health and safety of the citizens in the event of a radiological emergency. Thus, I am hopeful that the Nuclear Regulatory Commission will fulfill its mandato and carefully scrutinize the plan that has been filed for the Massachusetts communities surrounding the Seabrook facility.

It is my full intention to continue to closely monitor this matter and urge the commission to give serious and thorough consideration to the adequacy of this plan.
