COMMENTS FOR llEARING RECORD ON S.685 OGC l With regard to the additional comments on Title III, we note that S.685 l

would establish engineered long-tern surface or near-surface storage i

! facilities with appropriate monitoring and surveillance--not geologic l

repositories ~ as suggested by the proposed comments. Our interpretation of this Title has been supported by discussions with the Comittee staff. I suggest that the first paragraph be deleted, siting a surface storage l l facility is not a first of its kind activity. The reference to repositories l should be deleted in paragraphs two and three but the general thrust of l

i those paragraphs is appropriate. Paragraph three will coed considerable editing to remove the impression that we understand the facility that would be authorized by S.685 to be.a geologic repository (e.g., the references to disposal technology and the General Statement of Policy for licensing l geologic repositories should be. deleted).

While near surface storage facilities may be desirable or even necessary as part of an overall waste managaaent strategy, I reconuend that w maintain a position that the development of pennanent disposal facilities which do not require long-term monitoring and surveillance should not be slowed.
