Dear Mr. Pollock:
This letter is in response to your applications dated February 21,1997, and December 19,1997, requesting registration of the Model SH-300 Series and Model LS-101 level / density gauges.
We are in the process of evaluating your request. However, in order to continue our evaluation, the following information is necessary:
1.
Regarding the sample label for General Licensees, please (a) add a statement to the text on the label such as "This label shall be maintained in a legible condition" as specified in the provisions of 10 CFR 32.51(a)(iii);
(b) confirm that quality assurance measures will be implemented that verify, before shipments, that the proper labels have been applied to the devices which will be used by general licensees as well as to those which will be used by specific licensees; (c) note that the statement "[a]bandonment or disposal prohibited unless transferred to persons specifically licensed by NRC or an Agreement State" on the sample label is not j
in agreement with tne applicable regulations. Specifically, the statement excludes 7
transfers to general licensees; but the provisions of 10 CFR 31.5(c)(9) provide for such transfers. Please correct the issue regarding transfers.
2.
Please clarify whether (a) the operating manual is applicable both to specifically and generally licensed persons; or (b) one manual will be issued to specific licensees and another manual to general licensees? Please verify for Case (a) that the manual does not contain statements that may not be appropriate for both types of licensees, and for Case (b) that quality assurance measures will be implemented, before shipments, that the proper manual is sent to each licensee.
Please note that the registration certificate for the model SH-300 Series devices will specifiy a leak testing period of 3 years for units containing the Nuclear Research source model S-6, as previously approved. Current policy requires 6 month leak testing intervals, for specific-or general-licensed devices, unless the applicant provides adequate justification as listed in 10 CFR 32.51(b) or 32.74(b)(1). In accordance with this policy, the registration certificate will specify a leak testing period of 6 months for units containing the sources that you have requested to be added by this amendment. If you wish to request that the leak testing period for the newly added sources be extended, please provide the information listed above, or sufficient comparative justification relative to previously submitted information.
