TMIA'S REQUEST FOR AN EXTENSION OF TIME AND FOR A DELAY OF DISCOVERY TMIA hereby requests an extension of time in which to respond to the Report and Order On Initial Prehearing Conference dated February 27, 1986, and further requests a delay of the discovery schedule as set forth in the February 27 Order.

TMIA states the following reasons therefor.

During the February 19 prehearing conference, the parties tentatively agreed to a schedule for discovery which was to commence on March 1, 1986, subject to the approval of Judge Margulics.

On March 4, 1986, having received no word regarding the discovery schedule, the TMIA representative contacted Judge Margulies' office.

She was informed that an Order had been prepared and mailed on February 27, 1986.

Judge Margulies said that he would have another copy of the Order mailed to TMIA.

On March 7,.1986, two copics of the Order were received by TMIA; one stamped " Served March 3, 1986," is postmarked March 3, 1986; the other copy bears a March 4, 1986 postmark and was accompanied by a note from Judge Margulies' secretary stating that it was provided in response to TMIA's request.*

The Order allows the parties, other than the Staff, five days after 0603170125 050309 i
