October 15,1998 STATE OF UTAH'S MOTION FOR LEAVE TO REPLY TO APPLICANT'S AND STAFF'S RESPONSES TO STATE'S CONTENTIONS RELATING TO THE LOW RAIL TRANSPORTATION LICENSE AMENDMENT On August 28,1998 the Applicant amended its license application to account for a new transportation corridor and a char,ge in the location of the Rowley Junction intermodal transfer facility. On September 29,1998, the State filed Contentions HH ar.d II, and amended the basis for Contention B. The NRC Staff and the Applicant filed responses to the State's Contentions on October 14,1998.

4 Pursuant to Board's Memorandum and Order of February 2,1998 (Memorializing Initial Prehearing Conference Directives), the State motions for leave to reply to the Staff's and Applicant's responses. According to the Board's Order, a reply by the State would be due within ten days of the date the Staff and Applicant filed their responses (i.e., on or before Monday, 9810210046 981015 PDR ADOCK 07200022 C
