e NOTICE OF VIOLATION Illinois Power Company Docket No. 50-461 Clinton Power Shtion License.No. NPF-62 As a result of the inspection conducted on August 10 through September 6,1988, and in accordance with the 10 CFR Part 2 Appendix C - General Statement of PolicyandProcedureforNRCEnforcementActions(1988),thefollowing violations were identified:

1. 10 CFR 50 Appendix B Criterion XVI and the Illinois Power Company Operational Quality Assurance Manual, Chapter 16 states: Measures sia11 be established to assure that conditions adverse to quality... are promptly identified and corrected.

Contrary to the above, a condition adverse to quality was identified but not promptly corrected. On June 7, 1987 the licensee identified that revisions to valve and electrical lineup checklists were not being adequately evaluated against previously completed system lineups to determine if the system status was in accordance with the newly issued revisions. On August 25, 1988, the inspectors identified that the licensee's corrective action for the above adverse condition was not being properly implemented in that a random sample of 12 revised valve and/or electrical lineups were found not to have been performed upon issuance.

This is a Severity Level IV violation (Supplement !) (50-461/88021-01(DRP)).

2. 10 CFR 50.72 states: The licensee shall notify the NRC as soon as practical and in all cases, within four hours of the occurrence of... any event or situation, related to the health and safety of the public or onsite personnel, or protection of the environment, for which a news release is planned or notification to other government agencies has been or will be made.

Contrary to the above, on August 4,1988, the licensee notified the National Response Center, Illinois Emergency Services and Disaster Agency and Illinois Environmental Protection Agency of the discovery of a spill of approximately 79 gallons of sulfuric acid onto the floor of the Sediment Pond Filter House in the Waste Water Treatment System. This event was related to the safety of onsite personnel and the protection of the environment. The NRC was required to be notified within four hours of the notifications of other government agencies but was not notified of the event until August 18, 1988.

This is a Severity Level V violation (Supplement !) (50-416/88021-02(DRP)).

Consideration may be given to extending your response time for good cause shown.
