Dear Mr. Kingsley:

This will' acknowledge receipt of your letter deted September 10,1998, in response to our letter
dated August 11,1998, transmitting a Notice of Violation associated with inspection -
Report 50-254/98012(DRP); 50-265/98012(DRP).
'
In. your response to Violation 50-265/98012-05, a 10 CFR 50.59 violation regarding equipment
not meeting the National Electric Manufacturers Association standard for minimum running
,
voltage, you provided additional information that.was not made available during the inspection.
Specifically, a calculation (QDC-7800-E-0192) had been performed that showed the motors for
. the 2C and 2D residual heat removal service water pump room cooler ventilation fans would
i
meet the < National Electric Manufacturers Association standard and, in May 1997, the power -
feed cable to' MCC 29-2 was replaced which increased the minimum running voltage for the
Unit 2 emergency diesel generator cooling water pump. This new information showed that the
UFSAR discrepancy had been corrected at the first available opportunity after discovery of the

- condition. Since the new information 3 hows that the condition was corrected, no violation of
f
,
- 10 CFR 50.59 occurred, and the violation is being retracted. in discussions with the

- engineering staff, we learned that the new infonTiation was discovered during the preparation of
the response to the notice of violation. However, there were numerous opportunities for your
~
staff to provide this information prior to the issuance of the violation. The issue of the UFSAR
- discrepancy was first raised as a , Unresolved item in inspection Report 50-254/98009;
'
50-265/98009,1 and the issue was discussed at both the exit meetings for that report and for
inspection Report 50-254/98012; 50-265/98012. If this new information had been available
After the identification of the discrepancy in inspection Report 50-254/98009; 50-265/98009, the
unresolved item would have been closed and no violation issued. Therefore, in the future, we
t
would encoura9e timely resolution of identified unresolved issues in order to minimize the
impact of enforcement related issues on the staff of Comed and the NRC.
