Dear Mr. Lacker:
We are in receipt of your letter of April 6,1988 regarding the closure planforConocoInc.'sConquistaProject.
We have reviewed the comments 4
that were prepared by your staff, the Railroad Commission of Texas, and l
the Citizens for Closing the Conquista Tailings Pond that you transmitted 1
to Conoco.
Based on these comments, a very cursory review by my staff of a
the closure plan, our recollection of the issues discussed during our l
meeting and site visit of November 18, 1987, and the very helpful j
memorandum prepared by Ed Bailey regarding that site visit, we believe that you are addressing the major issues that need to be resolved.
Accordingly, it would appear to us that Conoco should be encouraged to j
authorize their contractor to prepare responses and make necessary design changes; particularly if they also consider the issues discussed in Ed i
Bailey's memorandum.

With regard to your desire to give Conoco, Inc. initial approval to l
r proceed with some reclamation activities, we see no reason why you should i
not authorize any activities you deem appro ylate.
We agree with your philosophy of getting rid of pond water and getting an interim cover in i
place as soon as possible.

We regret that we will be unable to respond to your~ request of December 8, 1987 to review and provide comments on the proposed plan.
Unfortunately, we must restrict our activities to assisting your staff on i
i specific issues or problem areas after you have completed your review.
