May 6,1988 NRC STAFF MOTION FOR FURTHER EXTENSION OF TIME IN WHICH TO RESPOND TO STATE OF VERMONT AND COMMONWEALTH OF MASSACHUSETT'S PETITIONS TO INTERVENE l.

INTRODUCTION On January 26, 1988, the Nuclear Regulatory Commission published in the Federal Register a notice of opportunity for prior hearing on a proposed amendment to revise the Technical Specifications in the Vermont Yankee Nuclear Power Stationis license relating to the testing of the re-maining train (s) of the Emergency Core Cooling (ECCS) and Standby Lla-uld Control (SLC) systems whenever one train has a component cut of service. 53 Fed. Reg. 21111.

On February 25, 1988, the State of Vermont filed a "Petition of the State of Vermont for Leave to Intervene."

Also on February 25, 1988, the Commonwealth of Massachusetts filed a "Request for a Hearing and Petition to intervene with Respect to Vermont Yankee's Request to Elimi-nate Certain ECCs and SLCs Testing Requirements."

THE MOTION The NRC staff has been pursuing a settlement agreement with the petitioners in the hope of resolving their concerns without the need for a hearing.

On March 15, 1988, the Staff sought and was granted a one-week extension of time until March 23, 1988, in which to file its response to Intervention petitions.

Memorandum and Order (Extension of Time / Mis-cellaneous Rulings), March 17, 1988.

On March 22, 1988, the Staff filed a motion for a further extension until April 6,1988, which was granted on March 23, 1988. On April 6,1988, the Staff filed a motion for further extension until May 6, 1988, which was granted by the Licensing Board on April 11, 1988.

The parties have continued to make substantial progress toward re-solving this matter.

The Director of Nuclear Reactor Regulation, Dr. Thomas E.

Murley, met with Vermont's Governor, the Honorable Madeleine Kunin, on May 3,1988, to discuss Vermont's concerns.

Wherefore, the Staff moves the Licensing Board to further extend the time for the filing of the Staff's response to the petition of the State of Vermont and the Commonwealth of Massachusetts by fourteen days from l

May 6 until May 20, 1988. M 1/

The Staff har filed a similar motion for further extension of time in another proceeding before another licensing board.

That proceeding on OLA-3 concerns logic system functional testing.

Stoff counsel telephoned Judge Bright on May 5, 1988, to indicate that the Staff would be filing the instant motion.

Judge Bright Indi-cated that the motion would be granted.
