IMPOSITION OF CIVIL PENALTY - $50,000 By EN 87-95 dated October 24, 1987 the Comission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penaltins in the cumulative amount of Fifty Thousand Dollars ($50,000) to Alabama Power Company. This action was based on several violations in the areas of procurement

and vendor interface.

The licensee responded to the Notice in a letter dated December 17, 1987. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed l
Imposition of Civil Penalties, with the exception of only a few examples.
The deletion of these few examples did not affect the Notice significantly and therefore the civil penalties have not been reduced. Accordingly, an Order Irrposing Civil Penalty in the amount of $50,000 has been issue) today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
