Dear Mr. Sinclair:

We have completed our review of the proposed Utah regulations sent to Ms. McLean on August 11,-1998 as follows:

1.

Requirements of General Applicability to Licensing of Radioactive Materials.

R31319-13. Exemptions, " Capsule containing carbon-14 urea for "in vivo" 4

diagnostic use for humans." As a result of our review, we have no comments.

2.

Transportation of radioactive material. R313-19-100. Proposed adoption by reference of,"10 CFR Part 71: Compatibility with the international Atomic Energy Agency." As a result of our review, we have one comment as enclosed.

Under our current procedure, a finding that a State regulation meets the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final State regulation. However, we have determined that if your proposed regulations were adopted incorporating our comment and without significant change, they would meet the compatibility and health and safety categories established in OSP Internal Procedure B.7.
