- SERVEDSEP 1 3 1300 50-335-OLA Dear Mr. Rich The Docketing and Service Branch received on September 7, 1988, an undated filing from you entitled "Intervenoris Statement of Haterial Facts as to Which There is a Genuine Issue to be Heard with Respect to Intervenor's Contentions" and supplemented by arguments on Contentions 3, 6 and 7 with attachments.
During the pendency of this proceeding you have repeatedly filed pleadings that do not conform to the Commission's rules of practice published in 10 CFR 52.
Your most glaring act of noncompliance has been the failure to attach a copy of a certificate of service to each pleading filed. However, a check of the record indicates that fortunately your filings have arrived in the hands of several parties through an exchange of documents among themselves.
Specifically, at times you have failed to comply with 10 CFR 62.708(d) by not providing to this office, which maintains the official NRC docket, the original and two conformed copies of each filing. You have also failed to comply with 10 CFR 52.712 which prescribes the procedure for service of documents in proceedings and the procedure for making proof of service.
It is essential to the adequate prosecution of a case by a party that all parties to and participants in the case be informed of the filings made by each.
To the extent that you have not complied with the rules of practice please be advised that your recent pleadings will not be entered on the official docket in this proceeding in accordance with the requirements of 10 CFR 62.709, until proof of service on the Licensing Board and all parties has been provided. In order to assist you in filing an appropriate certificate, I am enclosing herewith a copy of our official service list.
