Its charter will be filed in the next few weeks.

Please name the committee, provide the reason for the recommendation, and for those committees requiring legislation to effect termination, provide the citation to and a copy of the statute which directed or authorized the establishment of the advisory committee.
ANSWER The Commission at this time does not recommend termination of the Advisory Committee on Reactor Safeguards, its only statutory advisory committee.
l The Commission is planning to terminate, its High-Level Waste (HLW) Licensing Support System Advisory Committee later this year after it has completed the objectives for which it was established.
The Advisory Committee was established under Agency authority (Section 161a of the Atomic Energy Act of 1954, as amended).

The NRC terminated one advisory committee during the period 1985-1988.
The Ad Hoc Committee for Review of Enforcement Policy was terminated in December 1985 after completing its l
report to the Commission.
This comnittee was established by NRC pursuant to authority provided by Section 161a of the Atomic Energy Act of 1954, as amended, for the sole purpose l

The sole criterion applied by the Commission to a termination decision is whether the advisory committee has concluded the advisory process for which it was established.

Who has responsibility for accounting for the monies spent by advisory committees reporting to the President which are managed by the agency?
Who audits the books of the advisory committees and how often?
ANSWER The NRC's Advisory Committee on Reactor Safeguards has a full time staff which, among other things, is responsible for accounting for the monies spent by that committee.
For all of the other NRC advisory committees, an NRC official in the staff office which is cognizant of the services per-formed by the members and consultants of a committee pro-vides the administrative approval of all vouchers submitted l
by a member or consultant for his or her services.
This official is also responsible for keeping records of the 1
total expenses of the committee.
The cognizant official sends approved vouchers to the Division of Accounting and Finance, which is responsible for paying and recording costs in the official accounting records of the NRC.
None of the NRC advisory comraittees report to the President.

OIA's FY 1988 Audit Plan includes an audit of NRC's implementation of the Federal Advisory Committee Act.

The NRC Committee Management Officer is John C. Hoyle, who is the Assistant Secretary of the Commission (see attached organization chart).
Mr. Hoyle is a career civil servant.
As the CMO, Mr. Hoyle has the following duties:
managing the establishment process for new adviscry committees, l
managing the renewal process for existing committees, preparing annual reports, announcing committee meetings, l
making determinations with regard to the closing of meetings or portions of meetings, and providing advice to agency personnel regarding the requirements of FACA.
As the Assis-tant Secretary of the Commission, Mr. Hoyle is responsible for the day to day operations of the Office of the

QUESTION 7 Do you consider members of advisory committees to be regular government employees, special government employees, or independent contractors?
What criteria has the agency established to make this determination?
ANSWER Members of advisory committees may be either regular govern-ment employees or special government employees.
The crite-rion used to distinguish between these categories is the number of days worked.
Special government employees work 130 days or less while regular government employees work more than 130 days in a 365 day period.
However, members of the Advisory Committee on Reactor Safeguards are exempted from this criterion.
They remain special government employees for personnel purposes without regard to numbers 1
of days worked due to the statutory basis of their appoint-ments pursuant to Section 29 of the Atomic Energy Act of 1
I 1954, as amended.

OUESTION 7 (continued) In the unique case of the High Level Waste Licensing Support System Advisory Committee, which is participating in a negotiated rulemaking, the Chairman is an employee of the Conservation Foundation which is under contract to provide support for the negotiation process.
Two Committee members are regular government employees and the remainder serve without any direct employment or contractual arrangement with the NRC.

What is the practice in your agency of procuring confiden-tial statements of affiliations and financial statements from members of advisory committees and subcommittees in a timely. manner?
Who performs this function within the agency?

ANSWER I
It is NRC practice before appointment of committee members for the Office of Personnel or, in the case of the Advisory Committee on Reactor Safeguards (ACRS), the ACRS Committee staf f, to request a "Confidential Statement of Employment and Financial Interests",
F"" Form 443.
If the member is to be paid at a rate of GG-16 or above, and it is estimated that the menber will serve for 61 days or more during the next year, an Executive Personnel Financial Disclosure Report, SF-278, is requested.
These forms are reviewed by appropriate NRC staff officials and ethics counselors in the Office of General Counsel prior to approval of the appoint-ment.
Thereafter, in May of each year, an updated Form 443
QUESTION 8 (continued) or an updated Form 278 is obtained and reviewed by appropri-ate staff officials and OGC.
The Office of Personnel is responsible for obtaining Form 443s from members while OGC is responsible for obtaining SF-278s from any committee members required to file such a form.

QUESTION 10 How many advisory groups does the agency have which are not subject to FACA?

What is the arrangement by which the group's advice is being solicited?
ANSWER The NRC has seven standing internal agency advisory committees, which are composed antirely of NRC employees and are therefore not subject to FACA.
These committees are assigned a task by senior management and respond with a report which includes recommendations.
The names of the committees are:

QUESTION 11 With regard to committees that produce policy recommenda-tions, does the Designated Federal Official have the respon-sibility to determine whether the agency follows up on the recommendations or advice of the committee?
If not, who has that responsibility?
ANSWER Since NRC has historically had only a few advisory committees at any one time and has actively sought and utilized their advice, there has cxisted a close relationship between the sponsoring office, or the Commission itself, and each committee.
Therefore, there is direct follow-up by the sponsoring office or the Commission on committee recommendations or advice.
It is the responsibility of the Designated Federal Official, during the development of the annual report on committee activities, to review whether follow-up has been accomplished.

QUESTION 12 What is your reaction to a proposal to require the termina-tion of all advisory committees that held no meetings and issued no reports during the last year?
During the last two years?
ANSWER The NRC believes that such a requirement is unnecessary for non-statutory advisory committees.
The agency head has the authority to terminate such committees if he determines in the annual report process that the committee is no longer functioning as a committee and would not be needed again for the foreseeable future.
If there remains a potential need for the committee, the Agency head may determine that it would be more cost effective to retain the committee than to terminate it and subsequently incur the additional cost of reestablishing it.
Termination of statutory committees should require consulta-tion with Congress.

ANSWER GSA has not unreasonably delayed the chartering or rechar-tering process for NRC.
We believe there is a continuing need for the GSA function of collecting and organizing data for the President's annual report to Congress.
However, we bclieve GSA's role as clearinghouse for the chartering and rechartering of committees may no longer be necessary.
The individual agencies have now had 16 years experience with FACA and, in i
1 these years of very tight budgets, have sufficient financial incentives to continue to adhere to the purposes of FACA and l

Each sponsoring office utilizes its internal procedures for monitoring compliance.

What procedures are in place for this monitoring function?
ANSWER The Advisory Committee Management Officer monitors whether timely meeting notices are placed in the Federal Register.
In the NRC, where the number of advisory committees has been small, the ACMO has been able to maintain direct, close coordination with the support staff of advisory committees and, with minor exceptions, signs all meeting notices himself.
This centralized signature authority affords the ACMO the opportunity to monitor and enforce the timeliness provisions of the Act.

QUESTION 20 Can you identify any provisions of the Federal Advisory Committee Act which need greater clarification or specificity?
What are your recommendations for amending the Act?
ANSWER The Commission believes that while there is some ambiguity, FACA may be read to exempt from the coverage of that act any advisory committee subgroup which is not established directly by an agency head (or by the President in the case of Presidential advisory committees) and does not report to an agency (or the President) directly.
Such a reading permits necessary flexibility for subcommittees and other groups to meet on short notice to gather technical informa-tion, prepare preliminary reports, perform drafting services, and other such functions in support of the advisory committee.
Such a reading does not conflict with the policy of openness which underlies FACA because the public may attend meetings where these materials will be probed by the full advisory committee in the course of its 4

Moreover, the Commission believes that allowing subcommittees the flexibility of operation that in its view FACA contemplates will avoid the expense of needless formality and delay.
4 A clarification of the statutory language to ensure the availability of this reading of FACA would be helpful.
It could be easily accomplished by amending Section 3, the "Definitions" section, by adding an appropriate exemption to those already provided in subsection (2).
The proposed amendment would delete from subsection (2) the word "and" which immediately precedes "(111)" and would insert between the words "Federal Government" and the terminal period of subsection (2) the following phrase: "and (iv) any subcommittee or subgroup not established directly by an agency head or the President and not utilized directly by an agency or the President".

.s I EMPLOYMENT COHOITIONS FOR CONSULTANTS AND ADVISERS U. S. NUCLEAR REGULATORY COMMISSION 1. gPa. pay at the rate prescribed in the Letter of Appointment is paid for services performed for and at the request of the Connission. a. The full daily amount is payable for services of 8 hours or more in one calendar day, including services perfonned on a Saturday, Sunday, or holiday; or if your ordinary pursuits are effectively interrupted by your NRC service for 6 hours or more of one calendar, day. b. 1/8 of the daily rate is payable for eagh hour or major fraction thereof for service which is actually less than an entir'e 8-hour day, or if service is rendered entirely after your nonnal working day, or when your ordinary pursuits are effectively interrupted by your NRC service for less than 6 hours. c. Time spent in authorized travel is payable as if it were service as provided in 1.a. and b., above, except that time durjng travel is not payable if travel begins after 6:00p.m. on one day and ends before 8:00a.m. the next day (local time in the travel zone), and no payment shall be made for that portion of travel which extends beyond midnight and ends before 8:00a.m. the next day regardless of when travel began. However, if service is actually perfo-med during the hours under the above exception, a prorated amount is payable for the time service is performed, d. No aceitional pay is provided for services or travel in excess of 8 hours in any one calendar day; and, if you are employed on an intermittent basis, you cannot be paid overtime for Sunday or nightwork premium rate for work on a holiday. e. "The rate of pay prescribed in your Letter of Appointment is not ordinarily changed during the duration of the appointment. However, under special circumstances, an increase in the daily rate may be effected up to the maximum legal fee payable for consuitants. Examples of such special circumstances are: (1). Demonstration of competence in present NRC i:ensulting assignments which lead to increased value of the consultant's services to the NRC: (2). Where the consultant can demonstra+- that his o.r her services have been compensat u.:t a higher rate in other consultancies or in full tire employ ent in private industry. Such increases must be recommended and justified by your Cifice Director."

Your pay, if any, is subject c: deductions as indicated by a checkmark for: (X ) Withholding for Federal Income Tax, and any State or local income tax as prescribed by applicable state or local law. You are excluded from coverage under the Federal Employees' Group Life Insurance Act of 1954, 5 U.S.C. 8701-8716 and the Federal Employees Health Benefits Act of 1959, 5 U.S.C. 8901-8 13. (see Part II.A.14.c. and d. of Appendix 4139 for infoma-tion on reemployed annuitants). 7. Leave. If you are an intemittent consultant or adviser or do not have a prearranged tour of duty, you are not entitle to earn annual and sick leave under Annual and Sick Leave Act of 1951, as amended, 5 U.S.C. 6301 et, seq. If you have a regular tour of duty prearranged in advance, you are entitled to earn annual and sick leave. 8. Security Recuirements, it is understood that you agree to confom to all security regulations and requirements of the Comission; to be responsible for safeguarding the classified matter which may. be in your possessicn in connection with your NRC service; and to return, upon request, or epon termination of your service, any classified matter in your possession. 9. Conduct. It is understood that (a) you will become familiar with and agree to confom to the provisions of Comission policy and regulations regarding conduct of employees and conflict of interest (NRC Manual Chapter 4124), and political activity (NRC Manual Chapeter 4124), and (b) you will in the event of a change in your private employment or financial interests (as set forth in the statement you have filed with NRC, Fem NRC-443), report such change on a supplemental Form NRC-443 within 10 days following the end of the calendar quarter in which the change occurs and raise with the Comission any question regarding possible conflict of interest which may arise as a result of such change. A supplemental Form NRC-443 must be filed with NRC within 10 days following June 30 of each year while serving NRC whether or not there have been changes in your private interests during the preceding calendar quarter. NOTE: If you were excepted from furnishing a listing of financial interests as provided in NRC Appendix 4124, Part II., 735-28 (d)(4)(iv), the provisions of 9(b), above, do not apply with respect to the specific interests covered by the exception. 10. Inside Infor.ation. You are reminded that, under Appendix 4124, II., 10.735-51, you are to consider infomation obtained under Government authority which has not become part of the body of public information as confidential in your hands.
