NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTIES- $26,400 & DEMAND FOR INFORMATION This is to inform the Commission that a Notice of Violation and Proposed imposition of Civil Penalties in the amount of $26,400, as well as a Demand for Information, will be issued on or about July 10,1998, to Breitling USA, Incorporated. This action is based on two willful Severity Level 11 violations that involved the possession, use, and distribution of watches t
containing tritium (byproduct material) without NRC licenses. The Commission was consulted on this action in SECY-98-145 because ofits high regulatory significance. The Commission assented to the staff proposed action on July 9,1998.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule ofissuance and notification is:
Mailing of Notice July 10,1998 Telephone Notification of Licensee July 10,1998 The State of Connecticut will be notified.
The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalties may be remitted, mitigated, or imposed by Order.
