This responds to your letter dated September 29,1998 regarding Export License Application XSNM03058 which requested authority to export 62.234 kilograms of uranium containing 11.980 kilograms of uranium-235 (19.95 per cent maximum enrichment) to Japan for fuel supply for the Japan Materlats Testing Reactor (JMTR).
The application, dated September 10 and received on September 14, was forwarded to the Department of State (DOS) on September 16,1998. On September 24, DOS forwarded a cable

to the American Embassy in Japan which requested that they obtain a written confirmation from i
the Government of Japan that the above-mentioned material will be held subject to the Agreement for Cooperation between the Government of the United States of America and the Government of Japan Concerning the Peaceful Use of Nuclear Energy signed at Tokyo on November 4,1987, and that the proposed recipients are authorized persons in Japan.
The NRC is prepared to issue the license just as soon as we receive notification that the Government of Japan has provided the required assurances.
