Gentlemen:

We l' ave reviewed the letters dated Auguct 17, 1983, from AICbeaIE, Iuc. to the NRC concerning 'Jocket Numbecs 50-603 and 50-504.

Attached are some comments generated from the reviev and for which we still desire clarification.

Since oly, i

Charles P. West Division of Radiological Health CPW/E3018243 Attachaeot cci Dr. A. Thomas Clark, Jr. NRC Mr. W. A. Pfeifer, A1ChemIE Michael Pearigan, Deputy Attorney Geoeral

ALCHEMIE'S LETTER DATED 8-17-88 TO NRC COMMENTS 10 CFR 50 Noe Applical,ility (Revision 1 to Nov.17,1987 submitted) 50.34(b)(6)

AlchenIE ha s not shown Tennessee Department of Health (iii), (iv) and Environment (TDH&E), conclusively, that there is no radiological hazard.

50.34(b)(8)

A1ChenIE bas not shown TDH&E, conclustvely, that there 50.54(1-1) is no radiological hazard.

(j), (k), (1)

(s), (y) 50.34(c)(d)

Statement made that there are approximately 170 grass (c) of U-235 oc equipment.

In a letter to NRC, dated 50.54(p) 6/9/88, other numbers are given tha t differ from the above.

Which is correct? One hundred seventy scans is licensable under Tennessee regulations and i

jurisdiction.

10 CFR 50 EXEMPTION REQUIREMENTS 1.

A.

AlchemIT. has not positively showa TDH&E tha t there will be no radiological release.

Also, statewat is made that the "facility is to be used for the production of stable isotopes" but to July 20, 1988, letter from A1ChemIE to NRC, ites 2, it is s ta ted that Te11urtum-123 will be eoriched "to about 50" percent.

These t

statements present confusion that has not been clarified.

D.

Again AlchemIE has not shown tha t there will be "no threat of I

radiological release."
