SUBJECT:

ASSESSMENT OF REGIONAL IMPLEMENTATION OF ENFORCEMENT POLICY ,

As part of the assessment of the implementation of the enforcement policy by each Region, a review is being made of all Notices of Violation issued since July 1,1983 containing Severity Level IV and V violations which were not sent to IE for escalated enforcement action. However, because of the sensitive nature of the information contained in Notices of Violation resulting from safeguards inspections, the material cannot be discussed at sufficient length over the telephone to allow for a valid conclusion to be made concerning the appropriateness of the Severity Level assigned.

Dick Rosano will visit your office on April 11-12, 1984 to review the relevant Notices of Violation and to discuss his findings with you and with Safeguirds personnel responsible for the inspection results. Dick has already discussed this visit with you and the proposed schedule does not conflict with other connitments of yours. The enclosure describes the scope of the assessment and establishes a schedule for accomplishing it.

s . e REGIONAL ASSESSMENT Scope: To review inspection findings made, and Notices of Violation issued by the Region and to assess the appropriateness of the severity level assigned to violations issued by t1e Region without the concurrence of IE.

Method: -

1. Review all Notices of Violation issued since the beginning of assess-ment period.
a. Determine whether the Severity Level assigned to the violations is correct and in accordance with the Enforcement Policy,
b. For all .iolationi that could have resulted in escalated enforcement action but did noc, determine that the correct factors of the Enforcerent Policy were applied in the processing of the case, i' 2. Review inspection reports for which there were no Notices of Viola. tion issued. '
a. Determine whether there were any findings made in the inspection which could have resulted in a Notice of Violation,
b. For findings for which it appears that a Notice of Violation could have been issued. determine that the correct factors of the -
