September 28,1998 STATE OF UTAH'S MOTION FOR LEAVE TO EXCEED THE TEN PAGE LIMITATION FOR THE STATE'S CONTENTIONS RELATING TO THE LOW RAIL TRANSPORTATION LICENSE AMENDMENT The Board, in its February 2,1998 Memorandum and Order (Memorializing Initial Prehearing Conference Directives) set a page limitation of ten pages for "all motions and related responsive pleadings" absent preapproval of the Board to exceed the ten page limit. Order at 3.

The State requested permission from the Board in a telephone conference held today that it be permitted to file a pleading, not to exceed 20 pages. The pleading relates to new or amended contentions based on the Applicant's license amendment for a new rail transportation corridor along the western side of Skull Valley. The license amendment also changes the location of the Intermodal Transfer Point at Rowley Junction and makes other minor changes to the application.

I None of the parties object to the State's request. Nor does the State object to a request by attorneys for the Staff and the Applicant that they be accorded the same page limitation as granted to the State in responding to the l

State's newly filed contentions.

Pursuant to the Board's February 2,1998 Order, the State motions for l

approval to exceed the ten-page limit by an additional ten pages for the State's contentions relating to the Applicant's Low rail transportation license amendment.
