Dear Mr. Felton:
This is in response to your letter dated June 23, 1988, in which you appealed Mr. Grimsley's response dated June 3,1988. Mr. Grimsley's response denied portions of one record subject to your Freedom of Information Act (FOIA) request for an unredacted copy of an Office of Investigations' list of cases referred to theDepartmentofJustice(00J). The denied information is identified on the enclosed appendix.
Acting on your appeal, I have carefully reviewed the record in this case and have determined that the previously withheld information will continue to be withheld from public disclosure pursuant to Exemptions (5) and (7)(A) of the F0IA (5 U. S. C. 552(b)(5) and (7)(A)) and 10 CFR 9.17(a)(5) and (7)(i) of the Commission's regulations. Therefore, your appeal is denied.

The withheld information on the list relates to cases that are under consideration for prosecutive merit by 00J. Regarding your reference to case number 1-86-009, staff of the Office of Investigations noted that the connent "conviction on 88/03/15" was an error on the typed list and that this case is also under 00J consideration. The denied information is exempt from mandatory disclosure under Exemption (7)(A) and the deliberative and attorney i work-productprivilegesofExemption(5).
This is a final agency decision. As set forth in the FOIA (5 U. S. C, 552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia. j Sine.erely, !
