Dear Mr. Lofy:
This is in response to your letter dated July 18, 1988, in which you appealed Mr. Grimsley's response dated April 28,198L Mr. Grimsley's response denied one record subject to your Frt.edom of Information Act (FOIA) request for copies of nonproprietary versions of proposals which resulted in award of three specified NRC contracts and NRC's overall technical evaluation of the proposals.
The denied record is identified on the enclosed appendix.
i Acting on your appeal, I have carefully reviewed the record in this case and have determined that the denied record will continue to be withheld from public disclosure pursuant to Exemptions (4) and (5) of the FOIA (5 U.S.C.
1 552(b)(4) and (5)) and 10 CFR 9.17(a)(4) and (5) of the Commission's j
regulations.
Therefore, your appeal is denied.
This documert contains (1) financial cost and pricing information, the t
disclosure of which could cause competitive harm to the companies which provided the information; and (2) predecisional information containing advice, opinions, and recommendations, the disclosure of which would inhibit the candid and frank communications within the NRC staff.
Because release of this information would reveal important aspects of the deliberative process, disclosure would not be in the public interest.
This is a final agency decision.
As set forth in the FOIA (5 U.S.C.
