Dear Ms. Smith:
This is in response to your March 16, 1988 letter to Mary Beth Bradshaw, regarding access to criminal history records.
We appreciate your offer of assistance. However, at this time, the NRC is not seeking certification for access to Massachusetts criminal offender records.
The NRC requires power reactor licensees to fingerprint each individual granted unescorted access to the facility or access to safeguards information. All such fingerprints are submitted to the Attorney General of the United States through the NRC for identification and a criminal history records check. These requirements are codified in 10 CFR 73.57, implementing Section 149 of the Atomic Energy Act of 1954, as amended.
Licensees are required to make criminal history records, obtained under this authority, available for examination bj an authorized representative of the NRC to detennine compliance with the regulations and laws.
