PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Corsnission that a Notice of Violation and Proposed Irrposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be. issued on or about May 6,1988 to Comonwealth Edison Company. This action is based on three design control deficiencies which resulted in the Control Room Ventilation System being in a degraded condition. The deficiencies included a failure to properly translate design information into instructions, a failure to adequately test a modification and a failure to follow design procedures.
The escalation and mitigation factors of the Enforcement Policy were considered but no adjustment of the base civil penalty was deemed appropriate.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice May 6, 1988 Telephone Notification of Licensee May 6, 1988 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
