3 MR. CAMERON: We'll get started now with ou'r 4 meeting on the status of the decommissioning of the Peach 5 Bottom 1 unit. And I would like to welcome all of you to 6 this public member tonight. 7 My name is Chip Cameron and I'm the special 8 counsel for public liaison with the Nuclear Regulatory 9 Commission and my role tonight as facilitator or moderator 10 is to in general help you have an effective meeting. And 11 specifically I want to make sure that everybody who has 12 anything to say out there has a chance to speak. I want-to 13 make sure that all of your questions about the 14 decommissioning of the Peach Bottom I unit are answered, and 15 I also want to try to keep us on schedule and also keep the 16 discussion focused on the information we're here to bring 17 .you tonight. And that is on the decommissioning of the 18 Peach Bottom 1 unit. 19 As far as the Nuclear Regulatory Commission, the 20 NRC, is concerned, we have three objectives conight. One is 21 to tell you about the status of the decommissioning process 22 for the Peach Bottom 1 unit and also explain what the 23 regulatory framework is for the decommissioning of that 24 unit. 25 We want to answer your questions and hear your

          '3    'to factor in any of those concerns or comments into our 4      decisionmaking process on the decommissioning of the plant.

5 As Stu Brown, one of my colleagues from the NRC 6 will explain in a few minutes, this public meeting was 7 prompted by the relatively new NRC rules on the l 8 decommissioning of reactors. And one objective of that rule  : 9 is to make sure that the public has information on what a l l 10 particular. utility's plans are for decommissioning and what , 1 11 the NRC's role in the decommissioning process is. And the l 12 public meeting is provided for in those regulations and 13 that's why we're here tonight. 14 A few words about the agenda. And has everybody 15 got a copy of the agenda? I believe they were back on the 16 table. We have several presentations on the decommissioning 17 process both from the Nuclear Regulatory Commission and from 18 the utility. But we just don't want to talk at you so that 19 after each presentation we'll have questions and answers on 20 that particular presentation rather than waiting for the end 21 of everything. V l - 6 l 1 7:10 is the NRC's regulatory framework for reactor 2 decommissiodf$ndStuBrownfromtheNRCisgoingtodothat.. , 3 Stu, would you just stand up and identify yourself 4 to people? 5 Next, we're going to hear from the utility in 6 terms of what their plans are and Jay Doering is going to do 7 that presentation for us. And Jay, there he is back there, 8 will do questions and answers then. 9 Then we're going to switch back to the NRC to Tony 10 Dimitriadis. Tony is from our regional office and he's 11 going'to talk to you about the inspection process and also 12 specific inspection activities at the Peach Bottom Plant. 13 And after all of this there will be some time at 14 the end of the meeting where if we haven't answered -- if 15 there are still remaining questions, we will address those 16 or remaining comments. 17 Again, I'd just like to emphasize that we're here 18 to talk about Unit 1 at Peach Bottom and at decommissioning 19 there may be questions that there may be implications from 20 the other units for the decommissioning of this unit. I 21 don't know, we'll try to answer those, but for other types t 22 of issues, I'm going to ask the NRC staff to make themselves 23 available after the meeting. BROWN: Good afternoon. I'm Stu Brown the 23 project manager for the Peach Bottom 1 facility at the NRC. 24 I left several things at the desk and I would hope 25 that you would take them. BROWN: Yes, I will. 5 I would also left a copy of the two most recent 6 regulations that have changed, the reasons why we're having 7 this meeting, the decommissioning, the reactor 8 decommissioning, decommissioning regulation and the cleanup 9 criteria regulation. I also left a copy of my slides. The 10 slides have been annotated to indicate what part of the 11 regulation that they are addressing. Hopefully what will 12 happen is that -- well, what will happen is that we're going 13 to go through this fairly briefly, it covers a lot of l 14 material. And if you have questions I also left my card 15 there that if you have questions related to Peach Bottom 1, l 16 please feel free to call us, you have our 1-800 number. 17 With that, let's get started. 18 As I said, there are going to be a number of areas 19 that we're going to cover tonight fairly briefly. So, 20 therefore, a brief roadmap. We're going to cover the 21 , governing regulations, notification requirements, allowable 22 decommissioning activities, the decommissioning trust fund, 23 license termination plan, public participation, radiological 24 cleanup criteria, and license termination. 25 As I indicated earlier, I left copies of hoth 10 I ' ANN RILEY & ASSOCIATES, LTD.

I 10 1 CFR 50.82 and 10 CFR Part 20 for your information. Title 10 2 of the Code of Federal Regulations define and prescribe how *

                                                                                                                                                    ' ors 3  the NRC will conduct its business.                                                                                    And it defines how idle 4  licensees will conduct their regulated business.

5 The reason why we are meeting tonight is because 6 of the revision to 10 CFR 50.82. I'll talk about that a 7 little bit later. 8 First we're going to go through when does the 9 licensee have to provide notification to the NRC, when does 10 the NRC have to provide notification to the public? A 11 licensee needs to notify the NRC within 30 days of the 12 determination to permanently cease operations. We do 13 recognize that this facility has been shut down since 1974, 14 so, therefore, the licensee has complied with that part of 25 the regulation. But the regulations are written generally 16 for reactors that are currently in operation back to these 17 older facilities. 18 Next, the licensee needs to notify or provide 19 certification once the fuel has been removed from the 20 reactor vessel. That is a turning point which the licensee 21 would normally lose it's authority to operate the facility. 22 In this situation or this case the licensee has had its fuel 9JPW 23 removed from the stre back in 1977. 24 A licensee is required to provide a documant 25 called [ost-/hutdown Mcommissioning /E:tivities geport # ANN RILEY & ASSOCIATES, LTD. e-e 11 1 -to the NRC two years following permanent cessation of 2 operations. This facility has been shut down. When the 1 3 members of the staff were rewriting the regulation they 4 recognized that there would be a number of facilities that 5 have already been shut down that have had their 6 decommissioning plans in house either approved or in-the 7 process of being reviewed. Therefore, the staff made the 8 decision that for those situations the decommissioning plan 9 would be considered the PSDAR. 10 Next, upon receipt of a PSDAR, the NRC is required 11 to'have or hold a meeting in the vicinity of the site. 12 Well, that is the reason why we're here tonight. This 13 particular licensee, PECO, has had their planf# in house, it 14 has been approved, they have conducted a certain amount of M i 15 decommissioning already. Their facility is in Saf: CLurf"~ 16 but because the regulation has been revised and it is now 17 considered a PSDAR, the NRC is obligated to hold a public 18 meeting. That is why we are here tonight. 19 Now, the purpose of the revised regulation on 20

reactor decommissioning was to allow a certain amount of 21 flexibility in the decommissioning process. Previously a i j 22 licensee such as PECO would have had to submit a 23 decommissioning plan, have it reviewed and approved by the i 24 NRC and they would have to conduct their decommissioning in 25 accordance with that plan. 1 ANN RILEY & ASSOCIATES, LTD. k Court Reporters 1025 Connecticut Avenue, NW, Suite 1014 Washington, D.C. 20036 (202) 842-0034

12' 1 In accordance with the revised rule, the licensee 2 has greater flexibility on how they conduct their 3 decommissioning and what decommissioning activities they're 4 allowed to perform. First I'd like to go through and 5 indicate, or by definition show you what they are allowed 6 not to do or what they're prohibited from doing, and the 7 remaining area is what PECO or licensees such as PECO would 8 be allowed to do. 9 Licensees are not allowed to perform any major 10 decommissioning activities until 90 days after the PSDAR. 11 The licensee, PECO, has met that requirement. The licensee 12 shall notify the NRC and the State if it decides to - 13 significantly alter the information that was provided. 14 Now, please understand that this regulation was 15-ed written for facilities es the future that may come down for 16 decommissioning and facilities that.are currently in 17 decommissioning. The PSDAR has a timeline of major 18 decommissioning activities determined by the licensee in 19 their best interests. That allows the NRC to apply its 20 limited resources to come to the site to review 50.59s, and 21 we'll talk about that in a second, and the activities that 22 are occurring. 23 If the licensee makes the decision to change its 24 timeline to concuct these major decommissioning activities, 25 they are required to notify the NRC and the State so that we ( l_ ANN RILEY & ASSOCIATES, LTD.

13 1 can adjust how we're going to inspect and review. That's an 2 obligation to the licensee. But they're allowed to change l '3 'their plans, that provides them greater flexibility, but 4 also allows us to provide the oversight that we feel that's l 5 necessary. 6 A licensee is not allowed to or PECO or the 7 licensee will not be allowed to perform any decommissioning l 8 activities if it foreclosed the possible release of the site 9 for unrestricted use, and we'll talk about that when we get 10 'to the cleanup criteria, result in a significant

11 environmental impact, not previously reviewed, and result in i 12 there no longer being sufficient or adequate funds to 13 complete decommissioning. If that occurs, the licensee is 14 not allcwed to perform these activities.

15 Next the licensee is allowed to perform l 16 decommissioning activities under the provisions of 50.59 if 17 they complied with the provisions of 50.59. That will 18 require the licensee to perform an analysis, document that 19 analysis and subject to NRC review when we go on site. If 20 it complies with that, the licensee then can perform the 21 necessary decommissioning activity that it chooses to do. f 22 The decommissioning trust fund. Licensees -- and o 23 we're looking, again, at the broad spectrum -- are allowed 24 to use their decommissioning funds for decommissioning 25 activities. If the expenditures would -- excuse me. This licensee has performed that 8 analysis. They're in compliance. 9 A. licensee that is in a situation like this one, SW& 10 that's in a long-term Saf: CLvI condition needs to have a 11 means by going back and evaluating the cochs per year or 12 every so often to determine that their projections are 13 correct and r at they have a method by continuing to fund at 14 that rate. . they find out that it costs more, they're 15 obligated to put more into the fund. 16 . License termination plan. A licensee must submit 17 an application for termination of the license accompanied by 18 or proceeded by a license termination plan. A licensee must 19 submit a license termination plan as a supplement to the 20 FSAR or equivalent. Recently PECO did submit its updated 21 FSAR, it is available in the'public document room in hard 22 copy and on microfiche. 23 Now, a license termination plan needs to be

15 1 license. This document needs to contain several pieces of d 2 information, site characterization, that is that they've

  • gone through and determined where the radioactive 4 contamination is located. They need to provide 5

identification of the remaining decommissioning activities, 6 those things that they need to conduct or perform before the 7 license is terminated. Plan for the site remediation, hca 8 they're going to accomplish these things. Detailed plans 9 for the final radiation survey. They have to demonstrate 10 that the site is clean enough to be released, and they have 11 to have a plan that is in sufficient detail and reviewed by 12 the NRC so that we have confidence that they're going to be ~ 13 able to perform this survey acceptably. That is an

                        '14         important item.

15 They also must have a description of the end use. 16 If it's going to be restricted we will talk about 17 unrestricted and restricted in a minute. And updated 18 site-specific cost estimate, and a supplement to the 19 environmeny#report. 20 Public participation. When the NRC receives this 21 application for termination the NRC will offer an 22 opportunity for hearing in the process. It will be a 23 Subpart L hearing. Further, the NRC is required and will 24 have a public meeting similar to this in the vicinity of the 25 site. l ( , 16 I 1 Cleanup criteria. Essentially there are three 2 standards to which a facility can be or the license c,an be . 3 terminated. The first one a for unrestricted use. That is 4 if the licensee can clean up the facilit'y to less than or l l 5 equal to 25 millirem per year, and that is ALARA, then if 6 they can comply with that and demonstrate it, then the 7 license can be terminated without restrictions. 8 If it's determined by the licensee that they 9 cannot clean up a facility, to those standards, they can 10 come in and ask for restricted release. The NRC is in the 11 process of reviewing the criteria that's before the 12 Commission uf what would we find acceptable criteria for i 13 restricted releases. We could talk'about it, but it would 14 still be before the Commission. 15 I'm not going to go into detail on the third one 16

                                                  /h M because that's ultimate criteria and that is supposed to be 17     used in the rarest of situations.                                  And if a licensee cam ( in 18     and requested it, it would have to go to the Commission for 19     approval.                  So that's a very rare event.                        Or at least it's 20     envisioned to be.

21 License termination. Or do you mean giving up the 5 utilization license and having the possession only license? 6 MR. BROWN: You have a license which allows you to 7 possess the facility, but not operate the facility. 8 MR. KOHLER: That's correct. 9 MR. BROWN: We're talking about termination of the 10 NRC license completely. 11 MR. KOHLER: Completely? 12 MR. BRC Completely. And currently my - 13 understanding and I believe PECO will address this, what 14 their plans are, but I believe that they're not planning on 15 moving towards final decommissioning of the Peach Bottom 1 16 site until well after 2000, I thin't 2015. So, again, the 17 regulations are written generally for a lot of licensees, 18 some choose to go into immediate dismantlement and then 19 terminate their licensees, others such as this facility 20 which has other operating reactors on the site, may choose 21 to wait until they want to decommissioning the total site 22 and terminate each one of the licenses that they currently 23 possess. l Currently there are supposed to 6 be three options. l One of them is not viable, we are looking 7 at that. That's called entombment. The other two are S E 8 E26randdhaW W om. Saf Civi has taken the facility, putting 9 it into a condition which the facility can be left alone, l 10 would not expect to cause any impact to the environment, 11 that is, drain liquid systems that are not necessary. Once 12 you get to a state like the Peach Bottom 1 facility where 13 the fuel is removed from the site, that includes removing up 14 -- well, most fluid systems. You also want to harden or 15 clean up as much of the contamination as you can. You want , i i 16 to remove fire hazards so the facility is in a safe storage l 1 17 condition.

        '5                MR. BROWN:   Okay'. The NRC in the cleanup criteria 6   rule which I-left a copy in the back defined three levels, 7    unrestricted, restricted, and alternative.         Alternative 8   that's a rare event, not worth going into.         Unrestricted,
        -9     the licensee and the NRC would look at the remaining 10      activity on site after the licensee has performed sufficient 11      cleanup and we can make a determination that it is less than 12     or equal to 25 millirem a year.      If the NRC can make that 13     determination, then we can terminate the license without             '

14 restriction -- without restricted use. However, in some l 15 instances where that cannot be accomplished the licensee can 16 -- the NRC can terminate the license with restricted 17 conditions such as deed restrictions, providing the land to 18 the Government for oversight, there are several of them to 19 go into, but the issue is that if it's above 25 millirem 20 then you would have to look at restr$cted release. 21 MR. CAMERON: And " unrestricted" basically means 22 that there would be no restrictions on what the site could l 23 be used for such as residential, farming, things like that. l l 24 " Restricted" would mean that there would be restrictions, 25 limitations on what the site could be used for. These are hospital, university, industrial 20 users of nuclear materials, another set of licenses that NRC 21 has that are different from a nuclear reactor license. 22 MR. CAMERON: There have been reactors that have , 23 been released; right? 24 MR. BROWN: Right. Shoreham. CODY: I'm Michael Cody, and I'm with the York 5 Daily Record, and I just want to make sure I understand. 6 The short answer is, they have to apply for the 7 decommissioning because the regulations have changed. Is 8 there a second part of that, because the regulations have 9 changed and PECO wants to do something now, or just because 10 they have to get the paperwork -- 11 MR. BROWN: No , no -- 12 MR. CODY: -- up to date with the new regulations? 13 M2. BROWN: That's a lot of question there, but 14 let me try from what I think I understand. They don't have 15 to apply to decommission, they have to make an application 16 to terminate their license. That is the process ; hat kicks 17 in the hearing -- kicks in the hearing process by which the 18 license would be amended and offer an opportunity for a 19 hearing. Also that should be accompanied by a license 20 termination plan. That's one part of the question. 21 MR. CAMERON: I think Michael's concern may br 22 that -- and which I think we should clarify and I think Jay 23 is probably going to clarify it is, what's going to be -- 24 when you talk about scheduling major decommissioning 25 activities and things like that, what's going to be ANN RILEY & ASSOCIATES, LTD. No, that would be over here. I realize this 18 is a small picture, but this is Unit 1 here right at the end 19 of Adam Road. You come down Adam Road, this is Unit 1, and 20 this is one of the entrances to the site, and this is Units 21 2 and 3. And Unit 1 is surrounded by buildings now and 22 actually much of the Unit 1 building is being used as a 23 training facility at this time.   • history of Unit 1.

Fifty-three investors got together or 53 4 utilities got together, the largest group to ever get 5 together-in the United States in support of a nuclear 6: project like this. They formed a high temperature reactor 7-development associates and in 1958 they submitted a proposal 8' to the then U.S. Atomic Energy Commission.to develop and 9 build a gas cooled -- reactor. 10 This is a 40 megawatt plant. Just to put things 11 into perspective, Units 2 and 3 are about over 50 times as 12 large as what we're talking about here in' Unit 1. Unit 1 13 was a demonstration plant and it was a prototype for other 14 high-temperature gas cooled reactors to be built. That y4w

                .15              included Fort Saint Yosain which we juct discussed a few 16             minutes ago that's already been decommissioned and a few 17             other plants which were never built.

18 General Atomic Corporation was the supplier of the 19 reactor components and Bechtel Corporation was the engineer 20 and contractor and PECO and Philadelphia Electric Company 21 owned and operated the plant. The plant operates on a 22 combination of uranium and thorium fuel as graphite 23 moderator, the coolant is helium which is heated in the 24 reactor and it goes to the steam generators which produce 25 steam which ran the turbine. 30 1 Power operation for this plant began in 1967 and 2 became commercial in June of 1967 and it produced 1.2 , 3 million megawatt hours during its lifetime. Now, to put 4 that into perspective it takes about three weeks to generate 5 that much electricity with the current plants down there. 6 Decommissioning 1974, just after fuel load, I 7 believe it was, for Unit'3, we shut down Unit 1. The first 8 fuel shipment was in 1975 and correctly stated was in 1977

                                                               .S@*WAL 9  was the last fuel shipment and in 1978 we achieved the Safe 10  sac? status on the unit.

pysy w WHY 11 Next I'd like to mention some of the reaets7it"r 12 that remains in Unit 1. And I've put up there three 13 different years so you an see the decaying of the activity 14 activation products which are inside the reactor. You can 15 see they have decayed considerably from 2.9 mi4+dcuries 16 right after shut down until projected in the year 2026 down 17 to a thousand curies. There are also some radioactive 18 products in the coolant system, considerably less. We can 19 see in 1975 there were 30 curies and by 2026 we anticipate 20 that will be down to a little over six curies. 21 Now, we have a license, technical specification 22 for this plant. Presently that expires in the year 2015. 23 And the technical specifications require we do three 24 principal activities, that we establish an exclusion area 25 which is principally the primary containment vessel, what I ANN RILEY & ASSOCIATES, LTD. We have to conduct 2, radiological surveys within the plant and we have to check 3 for water accumulation in areas of the plant that are below 4 . grade and test that water. 5 What are our long-term plans? Well, the goal is a 6 to. remove residual radioactivity to permit release of the 7 property for unrestricted use and termination of the 8' license. We covered unrestricted use in the last 9 presentation and that's what our intention is. 10 And finally we'd like to talk about the benefits 11 of. deferring final decommissioning. The question was asked, 12 well, why are we here at the meeting; are we about to do 13 something? . No , as a matter of fact, we're not about to do 14 something. And there's significant benefits to delaying the 15 actual decommissioning dismantling of the unit. And that 16 is, you saw in the slides that had the radiation exposure or 17- the content in the reactor in the primary system, that just 18 continurs to go away with time. It reduces the expense and i

19 the decommissioning is to do that. It voids impacting Units 20 2'and 3, and I'll say, also our training activities which 21- are going on in buildings that are entirely surrounding that '

22 now. 23 And, finally, we anticipate that in later years 24 there will be better ways to decontaminate and dismantle 25 reactors of this type. So that would be the benefit. 32 1 requirement is that the decommissioning be completed in 60 2 years and we certainly would intend to have it done by ,then., 3 That concludes my presentation. 4 MR. CAMERON: Thank you, Jay. Could we have the 5 lights, and maybe just on your last statement about 60 years. 6 to give people an idea of what might be happening. 7 MR. DOERING: Sure. 8 MR. CAMERON: When 60 years starting -- I mean, 9 when does that start? I mean, when will 60 years finish? 10 MR. DOERING: Well, 60 years would be done in 11 October 31st of 2034. That would be 60 years after the 12 final shutdown on October 31st, 1974. 13 MR. CAMERON: Okay. 14 MR. DOERING: So that would -- that spans the 15 license life of Units 2 and 3 at this time. And so in all 16 likelihood the decommissioning would be conducted t 17 simultaneously. 18 MR. CAMERON: So I think that's an important point l 19 for people to realize is that the license at least the l 20 expected license life of 2 and 3 would be done by that and l 21 you would do the whole site, all the units at the same time. 1 l 22 MR. 34 1 trust fund for these plants or any other plants, but just 2 what our regulations require so you can get an idea of how 3 much assurance there is with what the objective of the 4 regulation is. 5 MR. LEWIS: The basic requirement and it's in di 6 50.82 and 50.75 or our regulations, 50.82 and 50.75, are 7 that a licensee has to be accumulating funds to fully fund 8 by the time that it is going to be in fact dismantling its 9 facility, that cost. The 1996 regulations which were handed 10 out today by Stewart move us very much in that direction in 11 terms of a licensee that is permanently shut down having to 12 maintain a fund that will grow and achieve the necessary 13 amount to totally cover its projected decommissioning costs. 14 Those projected decommissioning costs have to be analyzed by 15 the licensee to make sure that they are current. And under 16 the 1996 amendments to the regulations if there is a 17 significant change in the costs because of some -- either a 18 change in the decommissioning activities or for whatever 19 other reason that needs to be -- information needs to be 20 provided to the NRC, and, of course, would be public 21 information. 22 The NRC has also put out a proposed rule within 23 the last year or so and that regulation would also require 24 reporting to the NRC on the status of the decommissioning 25 fund and that basically is a regulation that proposed i ANN RILEY & ASSOCIATES, LTD. 35 1 regulation which the next step in the proposed regulation if I 2 our Commission agrees will be that it will become a final 3 regulation would provide for those funds to be reported to 4 the NRC and for a facility in the situation of Peach Bottom 5 Unit 1, they would.be required to annually report to us on 6 what the. status of their funds are. So those funds could be 7 monitored by the NRC as to their adequacy. 8 MR. CAMERON: Thanks, Steve. And I believe Tim 9 Johnson -- on that note Tim Johnson has an update on what 10 the actual decommissioning fund is for this particular unit dA) ' 11 Sacthis site. 12 MR. JOHNSON: For Unit 1 the amount in trust as of l 13 the end of-May was $10 million.and it's my understanding 14 that the total escimate for remediation will be about $60 j 15 million, and their objective is to make annual payments so 16 that by 2015 the date of the expiration of the license, they 17 will have full funding for the remediation. 18 MR. CAMERON: Yes, sir. l 19 MR. ADAMS: My rame is Kip Adams, I'm a local l 20 resident. Are these funds the expense of the 21 decommissioning to be borne by the rate payers, is it in the 22 rate base or is it something the investors have to bear? 23 MR. JOHNSON: I believe some of the money that's 24 in the trust fund now is paid by the shareholders. l 25 MR. ADAMS: And the rate payers F.re not -- l ANN RILEY & ASSOCIATES, LTD. 36 1 MR. JOHNSON: That's my understanding as of the 2 funds that are in the trust fund now. Now, that may change , 3 in the future, but the funds that are in the trust fund now, 4 as I understand it, come from shareholder funds and not rate 5 payer funds. 6 MR. CAMERON: I always hate to ask a lawyer to 7 clarify anything, but, Steve, do you have a -- 8 MR. ADAMS: Just t'o follow up on that again, the 9 stranded costs that are being paid for through the 10 deregulation process is only -- will those costs be part of 11 this decommissioning process, or is that just a -- 7.2 MR. CAMERON: I think he's going to -- 13 MR. ADAMS: -- or a capital investment cost? 14 MR. CAMERON: -- I think he'll tend not to preempt 15 you, but I think he has the answer. 16 MR. LEWIS: I would never preempt him. Okay. 17 Well, basically the costs and how they're going to be 18 collected, are the responsibility of the Public Utility 19 Commission of the State, whatever state -- wherever the 20 plant resides. And Public Utility Commissions may very well 21 decide that rate payers do -- will be assessed through rates 22 or some type of charges that the Public Utility Commission 23 assesses the recovery of the decommissioning costs. 24 As we move into so-called electric utility 25 deregulation, that will be a very important function and ANN RILEY & ASSOCIATES, LTD. 37 1 obligation of Public Utility Commissions, or this could also 2 be the Federal Energy Regulatory Commission of the United 3 States Government, FERC, for wholesale rates and interstate 4 electric costs.. But it will be an extremely important 5 function of the rate regulators to decide how they want to 6 apportion the costs as between rate payers and shareholders 7 of the generating company. 8 MR. CAMERON: Does that answer your question? 9 MR. ADAMS: Yes. 10 MR. CAMERON: Okay. And Steve will be here 11 afterwards too, if you want to get some more information on 12 that. 13 When Ray was beginning -- or Jay was beginning his 14 presentation, he talked about the fact that there were 15 members of the public here who included people who operated 16 and decommissioned this unit.' And I guess it would be 17 appropriate at this time to ask if any of those people had 18 any statements to make about that unit? 19 Yes, sir. 20 MR. BOYER: Vincent Boyer, former Philadelphia 21 Electric employee, and the first superintendent of Peach 22 Bottom Numbct 1. 23 With regard to the manpower, some people may have 24 a concern that we're going to flood the area with outside 25 transients to decommission the plant. I took my jacket off because it's a 9 little warm in here. .So I apologize. I'm a regional 10 inspector and project manager, you can pick any title you 11 want. My background is in health physics. And I've been 12 assigned to inspect Peach Bottom Unit 1. I was last at this 13 site in June 4th, I believe, something like that. And I'll

              -14      take you through what we look at, what we don't look at.              At 15      this point I think everybody has given you the most exciting 16     news, if you will. This is fairly boring, and, you know, as 17     a member of the public, myself included, that's a good 18     thing. So I'll just take you through the inspection or that t               19     process.

' l 3 The inspection responsibilities are currently l 4 under the Region I Office and I just put a couple things 1 5 together. I knew that the previous presenters would have l 6 some of this information, but I figure it's not a bad. thing I 7 to just make sure that we include these things. i 8 Number one, the status of reactor right now is  ! l 9 that it's sitting there until the year 2015 when Units 2 and 35#Egut  ! 10 3 are tentatively scheduled for decommissioning. And Sa4e l 11 Secf, we went over. Basically the objective of allowing a 12 reactor to sit there and delay the decommissioning is to 1 13 allow for the -- all the radioactive components to decay so 14 that it doesn't basically -- we can lower the exposure to 15 the individuals who would be working in the reactor site 16 when they're decommissioning. So just in case anybody had 17 any questions, why is this a good idea, that's exactly why. 18 There is no fuel at this site. As we've said

19. before, all the fuel was shipped out by 1977, there's no 20 water in the reactor fuel pool. And the contamination is 21' confined to.a couple of items, the reactor vessel, the 22 primary loop piping, steam generator, circulation pumps and 23 most of-the cleanup system.

,- 24 I toured those areas where all of these components 25 lie. Now, in some' areas I can't enter because it's just not

I mean, but basically I toured all                                                                     ,

3 the plant. We went into the various levels, I took 4 radiation levels, I took some wipes which I'll go over later 5 on, and just to make sure that everything is ta-teet, W l 6 there's no obvious hazards. That's the first thing that we 7 do as inspectors. 8 Let me move this up a little bit. The second 9 thing we do is called " characterization". Characterization 10 is one of the milestones or one of the areas, if you will, 11 that one has to reach in the process of decommissioning. 12 And characterization basically means you look at a site'and 13 you have to basically characterize where most of the hazards 14 are, what types of hazards, what kind of work will you need 15 to do to decommission and so forth. 16 And the characterization in accordance with my 17 inspection has been adequately carried out. The boundaries 18 of what's called an affected area have been obviously posted 19 and the licensee has taken good precautions.in identifying 20 areas cleared of obvious hazards. Basically what that means 21 is they've identified where -- you know, you don't want to 22 really go close to because, you know, there's contamination 23 of radiation levels and they roped it off and it's obvious 24 that you really can't enter in there. And so that part of 25 the decommissioning process called characterization has been ANN RILEY & ASSOCIATES, LTD. 1 43 1 done adequately. They've actually done a pretty good job. 2 The site security is controlled by the licensee. 3' . I can't just enter just because I want to, there are 4 obviously barriers and site security on the property. And 1 5 what we call the contamination, what we'll call licensed 6 material, it refers to the license that's being held right 7 now, the possession only license. ADAMS: Let me follow up just a little bit on 8 this. Are there routine emi'ssions from Unit 1? 9 MR. DIMITRIADIS: No , there's nothing. 10 MR. ADAMS: Zero emissions. 11 MR. DIMITRIADIS: That's why I said, it's pretty 12 boring. And that's what you want. There's no liquid, 13 there's no air releases, there's really nothing, you know, 14 there's steel that's contaminated that's sitting there, and 15 it's enclosed and in the vessel and -- 16- But the routine inspections are still made? 17 MR. ADAMS: Are there on-site monitors to pick up 18 any release of that Unit 1? 19 .MR. DIMITRIADIS: Well, there are, but it's a hard 20 ' question because if there were any releases they would be so 21 low that you would probably pick up more from, you know, L 22 something else rather than Unit 1. 23 MR. 47 1 is really -- but you do have dosimetry and things placed 2 around the area that's really monitoring Units 2 and 3. And 3 Unit 1 is not -- what Tony is saying here is, Unit 1 is not 4 adding anything above background to those levels. 5 MR. KOHLER: That's what verified by monitoring 6 spot in the equipment -- there's a breather pipe there with 7 an absolute filter in the pipe. And any gases or anything 8 that would go out and go through that absolute filter which 9 would collect everything and that's part of the inspection 10 to see if that absolute filter has picked anything up, and 11 it never has. 12 MR. DIMITRIADIS: Any other questions at this 13 time? 14 (No response.] 15 MR. DIMITRIADIS: Okay. The next thing that I 16 looked at during the inspection and I always look at it in 17 materials licensees and reactor licensees is the kind of 18 equipment that are used to do what we call the surveillance 19 l activities. The licensee goes into the Unit i enclosure and ' 20 they perform a surveillance activity that includes taking

     -21    radiation levels and then wipe testing to make sure that 22    there's no removal of contamination.           And so what I look at 23    basically is the equivalent that they use, is it working 24 properly, is it calibrated, is it the appropriate equipment 25    and so forth.      And they did use properly calibrated l

And I'd look at the 4 calibration records to make sure that they're calibrated on 5 a tinely basis. 6 The next thing I looked at is the radiation 7 protection program and that kind of is a general obviously 8 radiation is, you know, our concern. But when we talk about 9 radiation protection, we talk about controls. And one of 10 those controls, for example, is signing onto what's called a 1.* radiation work permit. Before you go and do some kind of a 12 function in a utility reactor like this, typically what you 13 have to do is you'have to read to make sure you understand 14 what the hazards may be. Of course, that covers some of my 1E training in addition, but they tell you specifically what 16 some of the hazards may be, what to expect, there might be a , 17 confined entrance for this and so we did that. 10 Also I looked at the years of experience of the If) individuals that performed these surveillance activities and i 20 there's a lot of years of experience at this site being 21 utilized to do these surveillance activities. And I think 22 an' interesting point is the fact that at exposures are kept

The posting and labeling is an 22 issue that we look at and basically we look at it to make 23 sure that the licensee has put signs up in the areas that 24 are a hazard to communicate to whoever is there to anyone 25 about the hazard that is present. And two different things, one is, I use a 7 meter to make sure that the radiation levels aren't i S inappropriate a'. Lhe area where I'm taking them, I should 9 say. Okay. 10 The second thing is, what I do is I take radiation 11 wipe surveys and what that basically means is I use some 12 kind of a filter to wipe qurfaces inside the reactor site 13 not anywhere where I shou.1d expect it. And they are 14 currently being done right now. Basically what that means, 15 is there anything that I would touch that would actually 16 contncinate myself or anybody else. And two of them have 17 come cut with zero which is what we should expect and I'm 18 still waiting for the third one. 19 The last two things, fire protection, Peach Bottom 20

                  -- well, PECO Energy has a fire protection program that's 21 really covered under Units 2 and 3 and it rea]1v encompasseu 22      Unit 1.      They have a fire hydrant, they have equipment 23 operators are trained for their f. ire brigade, and they also 24 have a back up fire protection program with the local fire 25      department.

2 I can't really see a large potential for fire there, , , 3 although, you know, it's basically steel and concrete and 4 there's nothing going on. 5 The last thing that I looked at is something that 6 Steve Lewis brought up that has to do with 50.75, our Code 7 of Federal Regulations Part 50 has to do with reactors, 8 50.75 has to do with decommissioning, funding, and records. 9 And 50. 75 (g) , I believe it is, talks about the licensee is 10 required to hold decommissioning records at a place so that 11 the institutional knowledge doesn't get lost. In essence, 12 if something happens that everyone should know about, the 13 history of the site that is, that the licensee have records 14 somewhere where they can find them, you know, quickly. And 15 I look at that and they have their binder and I look through 16 that. That's basically the majority of the inspection 17 program. I have to read some of their procedures which are 18 pages. I've been retired for a 11 years, 5 though I still have a great interest and I'm following 6 things in the technical literature and whatnot. We have 7 here at Peach Bottom Number 1 a very good concept and that's 3 not just -- I'm not just saying that because I was connected 9 with it, but it turned out Peach Bottom was the prototype i 10 that proved that the helium gas-cooled reactor would work 11 and would be safe, 12 The industry formed committees of which I was a 13 part, and we optimized the good features of this reactor and 14 got it developed up about four or five years ago to the 15 point where it could be built in a modular type of unit, it ] 16 could be built quickly, it would have been one of the most l 17 efficient, and safest reactor plants that could be built. i { 18 But as time has gone on the Government has shied away from 19 anything nuclear and I don't think we're going to get 20 another nuclear plant built until the President says, hey, 21 you know, we're in an energy bind here and we could help the 22 environment by building nuclear plants, and we ougnt to 23 build them. Then maybe the public attitude will change a 24 little bit and be a little bit more receptive. 25 MR. WISE: Yeah, Bechtel and the big boys are ANN RILEY & ASSOCIATES, LTD. J I 61 1 Would one of the people from the NRC just like to just say 2, briefly what the possibility is for a utility to do to renew 3 their license just very simply and then we can ask Jerry to 4 4 address that specific question. But put' it in context for l 5 us. 6 MR. BROWN: Currently, the licenses for Units 2 7 and 3 expire, I believe, the year 2013, 14, and Unit 1, I 8 believe is about 2014, 2015 -- 2000, I'm sorry. 9 If PECO does request and the NRC does approve 10 license extensions for both Units 2 and 3, PECO is allowed 11 to. request a license amendment to extend the date for Unit 12 1. They have done that in the past. It would be a license 13 amendment request. The NRC does process these and if the 14 licensee makes the determination after they have -- if they  ; 15 -- again, if they request a license extension and if it's 16 granted,.the licensee then can come in to try to correct its 17 paperwork if it wants to with respect to Unit 1, that would 18 be a license amendment request to extend the license date. 19 We would review it on its merit. 20 MR. CAMERON: Jay, do you want to add anything to 21 .that? Because I think you were talking about going on the 22 assumption that the normal course of business would be to 23 not renew one of the licenses after its 40-year -- you can 24 renew a license for 20 years, right, after the 40-year time 25 period. DOERING: One submitted for it, and we are 7 evaluating that for Units 2 and 3 as a business decision. 8 MR. CAMERON: And I guess just to clarify what Stu 9 said, if there was a license renewal decision made and the 10 NRC' approved that license renewal, then you would -- you 11 would factor in how you would treat the decommissioning of 12 Unit 1 in that context of the plants being operated longer, 13 and that might extend the decommissioning decision. 14 MR. DOERING: That would be correct and the 15 benefits which I talked about on the land -- 16 MR. CAMERON: Yes. 17 MS. ADAMS: If that extension is granted, do you 18 need an extension in order to keep and increase the fuel rod 19 storage in the above-ground pools? Because the pools are 20 there new, and will-ycu need to extend the license in order 21 to keep those pools there and to add to it? 22 MR. LEWIS ~: Yeah. 23 MR. NRC approval of a particular vendor's design of a spent-fuel 4 design cask arrangement. That requires -- that type of 5 approval requires that the licensee in this case, PECO, 6 continue to have a Part 50 license for their facility and so 7 there would indeed have to be an extension. There would 8 have to be an extension of their Part 50 license beyond the 9 current date for reasons of Part 50, but also that would 10 enable them to continue to make use of the so-called 11 " general license" which is something under Part 72 of the I 12 NRC's regulations for the storage of an on-site or adjacent 13 l to site spent fuel storage installation. l 14 MR. CAMERON: Okay. So they can consider that. 18 We will consider trying to -- any meeting that we 19 have to cast as wide a net as is feasible as we talked about 20 before. 21 Yes. 22 MR.
