TERMINATION OF YOUR NRC RADIOACTIVE MATERIALS LICENSE l Oa August 4,1998, you contacted the U.S. Nuclear Regulatory Commission and indicated that you wished to terminate your NRC radioactive materials license. The NRC staff has reviewed your sealed source leak test results. Based on its review, the staff has concluded that: ' 1) all licensable radioactive material has been removed from your facility: 2) residual radioactive material attributable to licensed activities does not exceed current NRC criteria. Based on these conclusions no further remediation or actions with respect to NRC regulated materialis required. Your facility is suitable for unrestricted use and NRC license number SNM-1921 for your facility at Station A, Durant, Oklahoma, is hereby terminated. - Durant, Oklahoma 74701-0609 (405)924-0121 August 4,1998 Ms. Vivian Campbell NRC Region IV Last week one of your field officers, Jeffrey Cruz, showed up and examined the paperwork associated with a Numec plutonium / beryllium (PuBe) neutron source, previously owned by Southeastern Oklahoma State University, which was shipped to LANL in March of this year. Somehow I had thought that the QC paperwork submitted to NRC during the transfer process would make it automatic (i.e., close out the license), but I leamed through Mr. Cruz that a further form was needed (NRC form 314). 'Ihe latter is being submitted with this letter.
During the visit Mr. Cruz said that our paperwork didn't sufficiently document that the nuclear , materials item had in fact reached LANL, which was w ry troubling to me. I then made contact with Ms. ; Sherry Jones at LANL (yesterday) - she operates the LA.NL plutonium recovery program - and Sherry advised me that DOE /NRC form 741, which Mr. Cruz examined (and I think he made a copy ofit using my Xerox machine) was in fact the valid documentation that NRC would need to close out our license. The 74I shows that a Ms. Gabriella Rodriguez officially received the PuBe capsule on March 17,1998; we had shipped it on March 9,1998. So as proof that the PuBe source has been transferred to LANL,I'm submitting not only a copy of the DOE /NRC 741 but also other pertinent documents, e.g., the transfer of ownership letter, the Roadway Bill of Lad ng, the last leak test's results, etc. I hope my actions will be sufficient to clear our records of of this item, which I personally regarded as a serious liability. The source never failed a leak test while it was under my supervision, and the previous responsible official (Dr. Barker, uaw retired but still living) informs me that it never leaked under his supervision. At first I had used solid state alpha counting equipment and a gamma scintillometer (and long counting times .ar both the wet swab and background readings) to test for leakage, but early-on I thought it would be a better idea to submit the test samples to an independent lab for mesurements. Thus,I began submitting my swab tests to Suntrac Services,Inc. If the source had ever leaked,it would have been brought to your attention immediately. During my tenure as the licensee, the storage room was fitted with a second lock (an electronic keypad type with an audible violation alarm); i.e.,it required a regular (mechanical) key and knowledge of the restricted entry code to get into the PuBe room. The QA Program is implemented by Dr. John R. Wrip,ht. Professor of Chemistry and NRC Licensee Department of Physical Sciences (Name. Title & Department of IVroon 1(capona6ble for the Shipment) The NRC Licensee is responsible for the overall 01tle of responalble indMdua0 administration of this QA program, including training of personnel and all quality-related activities regarding the shipment of 239P uBe neutron sources. These quality-related activities include, but are not limited to, inspection and identification of each DOT 6M upon receipt from IANL, or a Shipping Broker, as well as proper handling, packaging, inspecting, testing, and recording each shipment.
- 2. Quality Assurance Program (10 CFR f .71.105)
The management of Southeastern Oklahoma State Univ establishes and (Site Name) implements this QA Program based on the LANL manual " Plutonium l Beryllium (239 PuBe) Neutron Source Recovery Program", dated March 1997, which is part of this QA Program. Training on the LANL manual for all QA functions is required before any quality-related acuvities are performed. The QA Program will emphasize control of the characteristics of the ' transportation package which are critical to safety.
- 3. Document Control (10 CFR 5 71.113)
All documents related to each shipment of 239PuBe neutron sources will be controlled. The NRc Licensee shall assure that all 01tle of responsible trulMduaU QA ftmetions are performed in accordance with the IANL manual.
- 4. Handling, Storage, and Shipping Control (10 CFR 6 71.127)
The procedures in the LANL manual will be followed concerning the handling, storage, and shipping of transportation packages. Shipments will not be made unless tests, certifications, acceptances, and final inspections have been completed.
- 5. Inspection, Test, and Operating Status (10 CFR 5 71.129) i Inspection, test, and operating status of each transportation package for shipment of 239PuBe neutron sources will be documented. Transportation package status will be indicated by tag, label marking, or log entry.

Nonconforming parts or transportation packages will be positively identified and segregated to avoid inadvertent use.
- 6. . Quality Assurance Records (10 CFR 5 71.135)
Records of transportation package inspections and tests will be retained for three' years beyond the date this QA program ends. Records of.cach shipment will be retained for three years after each shipmedt occurs. The -
