Dear Mr. Rael:
The U.S. Nuclear Regulatory Commission (NRC) received the Vicinity Property Completion Reports (CRs) for the five subject propedies in the Johnson Creek area of the Maybell, Colorado, Uranium Mill Tailings Remedial Action Project site from the Department of Energy (DOE) by letter dated February 4,1998. The NRC staff forwarded comments on all five CRs to DOE on April 2, 1998. DOE provided its responses and corresponding page revisions for the CRs on June 5,10, 23,26,29, and August 20,1998. The NRC staff's concurrence is required on these CRs, because DOE applied supplemental standards to these properties.
The CRs contain a supplemental standards application to leave elevated radioactivity in the Johnson Creek bed. The Johnson Creek properties contain elevated levels of radium, thorium, and uranium, in part due to spotty deposits of uranium mill tailings, but mainly due to in situ ore deposits and drainage from nearby uranium mine pits. DOE based the application of supplemental standards on Criterion b of 40 CFR 192.21, because excavation of the contamination would result in a high remedial cost and low / insignificant health benefit. Also, at severallocations access would be difficult because of the steep terrain, and environmental harm would result from disturbing the sparse vegetation. There were no buildings on any of the properties.
Based on its review of the revised CRs, the NRC staff concludes that DOE's remedial action complies with the remedial action plans and with the supplemental standards regulation. The l'

properties is enclosed. The forms have been signed, indicating NRC staff concurrence. Please note that you have neglected to sign the form for Vicinity Property CR No. MB-006S. Please sign and date the enclosed copies for that VP, and retum one original copy to the NRC to the attention of Mr. Robert Carlson, Project Manager for the Maybell site.
