Subject:

Response to Notice of Violation (Inspection No. 50-309/88-10)

Gentlemen:

This letter is in response to your letter of July 7,1988, notifying Maine Yankee of a Severity Level III violation. This violation involving failure to transfer radioactive material to an Agreement State licensee in accordance with the Agreement state license requirements was identified by the Agreement State, South Carolina.

The waste shipment in question did not violate any specific Federal packaging or shipping requirements.

The violation, its root cause and the corrective actions that have or will be taken by Maine Yankee, have been discussed with state officials at a meeting in South Carolina.

He have also made a written submittal to the state describing the actions we have taken to prevent future non-conformance with state regulations.

The State of South Carolina has reviewed our submittal and has agreed with our identification of the cause of the violation and with the actions we have taken to prevent recurrence of this type of incident. As a consequence of J

this favorable review, the state has lifted the suspension of our South Carolina Maste Transport Permit.

The waste shipment in question has been Ei returned to Maine Yankee for repacking.

-n Condition 38 of the Chem-Nuclear System radioactive rnaterials license 68 issued by Snuth Carolina limits the activity of material to be accepted as 02 0 Class A unndle waste to less than 1 uCi/cc for nuclides with half-lives bz:

greater than five years. He have determined that the root cause of our og exceeding this limit was that our procedure for alipping radioactive waste iQ failed to specifically address this requirement. He have revised our

[

procedure for :; hipping radioactive waste to address this requirement.

OE An internal review of our procedures has been conducted to ensure conformance to all Barnwell licei, ' criteria. A review of our procedures will be conducted to ensure that they cv )rm to the site license requirements at other burial sites.

This latter review will be completed prior to making future low level waste shipments to other sites.

MaineYankee United States Nuclear Regulatory Commission Page Two Attention: Mr. Hilliam T. Russell MN-88-81 Full compliance was achieved by July 11, 1988 with the revision of our procedures for waste handling.

He request reconsideration of the severity level of this violation.

The shipment did not violate any specilic federal regulations for radioactive material shipping except one that required meeting state requirements. A review of similar violations at other facilities indicates that similar violations are typically categorized as Level IV.
