SUMMARY

OF PUBLIC MEETING HELD ON SEPTEMBER 2,1998, WITH ENTERGY NUCLEAR, INC.

On September 2,1998, the staff held a public mesting with representatives of Entergy Nuclear, Inc. (ENI) at NRC Headquarters in Rockville, Maryland.- The purpose of the meeting was to discuss issues regarding the review of license applications for the sale / purchase of nuclear plants. A list of attendees and their affiliations is provided as Attachment 1.

ENI was formed in February of 1997 to provide ' management services to the nuclear industry.

Maine Yankee was their first management services contract. Currently, with deregulation and divestitures, ENI has a larger growth strategy and is looking to take equity ownership interests in some plants. ENI also offers management services and decommissioning services. ENI's intention in acquisitions is to become the majority owner and operator of the plants, with current plant employees becoming employees of Entergy.

Discussions included the license transfer application process, transfer options, NRC expectations for applications, foreign ownership questions, decommissioning funding questions, and review time frames. The staff commented that there were some uncertainties in review time estimates. For example, antitrust issues could require referral to the Department of Justice, possibly adding nine months or more to the review process. A request for a hearing over the proposed transfer could also affect the schedule. One staff member commented that the fact that the review would concem a generator selling electricity in the open market with no fixed service territory would probably not be an antitrust concem.

ENI asked about the financial qualifications Standard Review Plan (SRP), currently before the Commission. The staff responded that SRP issuance was imminent and that a new decommissiening rule will also be issued soon.

' The final part of the meeting was proprietary and was closed to the public. Discussions involved attemative forms of business structures and proposals as well as future plans for ENI.
