Dear Mr. Chainnan:
The Omnibus Budget Reconciliation Act of 1987 (Public Law 100-203) enacted by Congress in Decenber 1987 requires that the Comission collect not less than 45 percent of its budget in fees for FY88 and FYB9. To assure that this statutory mandate is met for FY88, the
'Comission is issuing revisions to 10 CFR Part 171 as an interim rulemaking notice. The interim rulemaking would increase the current percentage for collections of annual fees under 10 CFR Part 171 for operating nuclear power plants from 33 percent to 45 ' percent. It will be superseded by the final rule resulting from the proposed revisions of 10 CFR Parts 170 and 171 published in the Federal Register _ on June 27, 1988, when it is finally published. The final rule will apply to fee!
for FY89.
Enclosed is a copy of the interim rulemaking for changes to 10 CFR Part 171 that was published in the Federal Register. _
