Order Imposing Civil Monetary Penalty
Dear Mr. Lieberman:
In response to the Notice of Violation and Proposed Imposition of Civil Penalty dated March 17,
- 1988, Wolf Creek Nuclear Operating Corporation (WCN00) subnitted to you on April 14,
- 1988, a detailed Request for Mitigation of Proposed Civil Penalty, together with the Answer to Notice of Violation.
WCNOC believed
- then, and continues to believe now, that mitigation was appropriate and should have been granted.
WCNOC was therefore extremely disappointed by the July 28, 1988 Order Imposing a Civil Monetary Penalty which denied mitigation.
Notwithstanding WCNOC's right to request a hearing on the July 28 Order, and WCNOC's continued belief that it was inappropriate to use the number of events to both increase the severity level and to increase the civil penalty above the base amount, a check is enclosed in the amount of $100,000 made payable to the Treasurer of the United States.
