Docket Nos. 50-443, 50-444 - o On-Site Emeroency Planning and Safety Issues

Dear Administrative Judges:

Pursuant to the Baard's order of June 23, 1988, this is to inform you that the NRC Staff does not plan to move for summary disposition of remanded NECNP Contention I.8.2.

On August 19, 1988, Applicants advised the Board and the parties that they intend to move for summary disposition of this contention.

The Staff has maintained on several occasions--most recently in its filing of Ju'y ?7, 1988--that the record contains sufficient evidence to enable the Bo

> issue a decision resolving remanded NECNP Contention I.B.2. favorably to A plicants.

For this reason, the Staff likely will support Applicants' motion for summary disposition.

prberely,
