ENCI OSURE NOTICE OF VIOL 4 TION Windsor Power House Coal Company General License Windsor Heights, WV (10 CFR 31.5)  ;

l Ouring the Nuclear Regulatory Commission (NRC) inspection conducted on July 1, 1988, a violation of NRC requirements was identified. In accordance with the i "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR I Part 2, Appendix C (1988), the violation is listed below:  ;

l 10 CFR 31.5(c) requires any person who requires, receives, possesses, uses I or transfers byproduct material in a device pursuant to the general l license in 10 CFR 31.5(a) to comply with the requirements in  !

10 CFR 31.5(c)(1) through (c)(10). l 10 CFR 31.5(c)(2) requires the general licensee to assure that the i device is tested for leakage of radioactive material and proper operation of the on-off mechanism and indicator at no longer than i six-month intervals or at such other intervals as are specified in )

the label. I The Commission has authorized labelling to require tests for leakage of radioactive material and proper operation of the on-off mechanism and indicator at no longer than three year intervals. i 10 CFR 31.b(c)(4) requires the general licensee to maintain records showing compliance with 10 CFR 35.5(c)(2) and (3). The records shall show the results of tests. The records also shall show the dates of performance of, and the names of persons performing, testing, installation, servicing, and removal from installation concerning the radioactive material, its shielding or containment. Records of tests for leakage of radioactive material required by 10 CFR 31.5(c)(2) shall be maintained for one year after the rext required leak test is performed or until the sealed source is transferred or disposed of.

Records of tests of the on-off mechanism and indicator, required by 10 CFR 31.5(c)(2), shall be maintained for one year after the next required test of the on-off mechanism and indicator or until the sealed source is transferred or disposed of.

Contrary to the above, the general licensee failed to maintair. records of leak tests and on-off mechanism and indicator tests for inree (3) Kay-Ray Inc. gauging devices (Source Holder Serial Nos. 12516, 12517, and 12518) that were leak tested on November 14, 1984. The licensee failed to maintain records of the on-off mechanism and indicator tests for a Kay Ray Inc. gauging device (Source Holder Serial No.12518) that was installed 8800240098 080815 REG 2 LIC30 PNU ,

n Notice of Violation 2 after repairs in March 14, 1985. Also, the general licensee failed to maintain records of the on-off mechanism and indicator tests for two (2)

Kay Ray Inc. gauging devices (Source Holder Serial Nos.12516 and 12517) that were. tested on October 28, 1987.

This is a Severity Level V violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, Windsor Power House Coal Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly-marked as a "Reply to a Notice of Violation" and should include for each

' violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when. full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause. why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be '

taken.
