INTEGRATED MATERIALS PERFORMANCE EVALUATION PROGRAM (IMPEP) REVIEW OF KANSAS RADIATION ,

CONTROL PROGRAM  !

t l This memorandum transmits to the Management Review Board (MRB) a proposed final report l (Attachment 1) documenting the IMPEP review of the Kansas Radiation Control Program. The l review of the Kansas program was conducted by an interoffice team during the period l June 15-19,1998. The team issued a draft report to Kansas on July 22,1998, for factual comment. Kansas sent factual comments by letter dated August 20,1998, from Vick L.

Cooper, Chief, Radiation Control Program, Bureau of Air and Radiation (Attachment to l proposed final report).

l l, I The review team found the State's performance satisfactory in Sections 3.2 and 4.1, Technical Ouality of Inspections and Legislation and Program Elements Required for Compatibility, ,I I respectively. The team found the State's performance satisfactory with recommendations for improvement in Sections 3.3 and 3.5, Technical Staffing and Training and Response to incidents and Allegations, respectively. The team found the State's performance unsatisfactory in Section 3.1, Status of Materials inspection Program, due to the number of overdue inspections completed during the review period, and Section 3.4, Technical Quailty of Licensing Actions, due to chronic problems with respect to thoroughness, completeness, consistency, 1 clarity, and technical quality of licensing actions. The State informed the NRC of its plans to ,

correct the review team's findings in a July 9,1998 letter from Vick L. Cooper, Chief, Radiation Control Program, Bureau of Air and Radiation (Attachment to proposed final report).

MRB Members 2 Based on these indicators, the review team recommends that the MRB find the Kansas program to be adequate to protect public health and safety, but needs improvement and compatible with the NRC's regulatory program. Due to the significance and number of deficiencies found in the Kansas program that included unsatisfactory ratings for the common performance indicators, Status of Materials Inspection Program and Technical Quality of Licensing Actions, the team recommends a period of heightened oversight for a duration to be established by the MRB.

The MRB meeting to consider the Kansas report is scheduled for Wednesday, September 9, 1998, from 10:00 a.m. - 12:00 p.m. In One White Flint North, Room 3-B-4. In accordance with Management Directive 5.6, the meeting is open to the public. The agenda for that meeting is attached (Attachment 2).
