Dear Commissioners:

On August 18,1998, the Management Review Board (MRB) met to consider the proposed final Integrated Materials Petformance Evaluation Program (IMPEP) repor1 on three of the four pr23 rams that implement the Agreement with the State of New York. The three programs represented at the MRB meeting were the New York City Department of Health (NYCH), New York State Department of Health (NYSH), and New York State Department of Environmental E

Conservation (NYDEC). The MRB made a preliminary finding that the New York program is adequate to protect public health and safety and compatible with NRC's program. A final finding tvill be made following the MRB meeting on September 1,1998 addressing the New York State Department of Labor (NYDL) program. A revised report will be issued following the September 1,1998 MRB meeting.

' The MRB directed the re,riew team to revise NYCH's rating for the common performance indicator, Status of the Materials Inspection Program, from " unsatisfactory" to " satisfactory with

/j recommendations for improvement" based on their actions taken to correct their licensee 7

database. The review team was directed to assess the apparent discrepancy between NYCH and NYDEC's ratings for the common performance indicator, Technical Staffing and Training.

l In response, the team has revised NYCH's rating for this indicator to " satisfactory." This matter will be presented to the MRB for final resolution at the September 1,1998 MRB. The MRB also

directed the team to clarify the recommendations on the reporting of incidents and events to the NRC.

Section 5, page 44, of the enclosed final report presents the IMPEP team's suggestions,
