SUBJECT: WITHDRAWAL OF NOTICE OF VIOLATION

Dear Mr. Cruse:

This letter withdraws a Notice of Violation issued as part of Inspection Report 50-317;-

318/98 80, dated April 14,1998, regarding test control of post installation testing of the

battery for the 1 A emergency diesel generator (EDG). Your response to the violation in a

letter dated May 14,1998, stated that " Baltimore Gas and Electric Company denies the

)

alleged violation ..., but does acknowledge that the calculation was not easily auditable."

Based on our subsequent review, we have concluded that your position is correct and have

i

decided to withdraw the violation.

Specifically, the violation stated that the testing procedure for the 1 A battery " failed to

incorporate an appropriate acceptance criterion for the battery service test," and that the

acceptance criteria, a test shutdown criterion of 111 volts, differed from calculated

minimum voltages of 117.6 volts on the de.;ign of some associated equipment. Your

letter provided the bases for the apparent voltage discrepancy (differences in cable lengths

of control circuits for the two diesels covered by design calculations).

resulting voltage is sufficient to operate the applicable equipment. Your stated corrective

actions included clariSations on the associated design calculations.

Regardless of the violation's withdrawal, we believe the design control of this testing

evolution was weak, despite being found to be correct after the f act. We hope your

evaluations will enable future post-installation testing which is more thorough and

thoughtful.

We have reviewed the corrective and preventive actions for the remaining violation, as

documented in your letter, and have found the actions to be appropriate. These actions

will be examined during a future inspection of your licensed program.
