NOTICE OF VIOLATION Toledo Edison Company Docket No. 50-346 As a result of the inspection conducted on November 5, 1985 through January 4, 1986, and in accordance with the " General Policy and Procedures for NRC Enforcement Actions " 10 CFR Part 2, Appendix C. (1985), the following violation was identified:
10 CFR 50, Appendix B, Criterion IV, " Procurement Document Control," states in part:
" Measures sha~ll be established to assure that applicable regulatory requirements, design bases, and other requirements which are necessary to assure adequate quality are suitably included or referenced in the documents for procurement of materials, equipment, and services."
In addition, administrative procedure AD 1846.00.05, " Requisition of Materials and Services" requires an adequate technical review be performed prior to procuring materials and services.
Further, 10 CFR 50, Appendix B, Criterion XV, " Nonconforming Materials, Parts, or Components," states in part: " Measure shall be established to control materials, parts or component which do not confonn to requirements in order to prevent their inadvertent use or installation."
Contrary to the above, a pyrometer was procured with incorrect internal resistance and installed on September 17, 1985 on Energency Diesel Generator (EDG) 1-1 without assuring that the pyrometer conformed to requirements.
In addition the licensee failed to perform an adeo.9te technical review prior to procuring the pyrometer. The bearing temperature pyrometer (T! 21077) did not impact the operability of the EDG.
This is a Severity Level IV violation (Supplement 1).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:
(1)correctiveaction taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Considerattor,may be given to extending your response time for good cause shown.
