APPLICANTS' ANSWER TO STINER REQUEST TO INTERVENE LATE By its memorandum of Jan;.ary 22, 1986, the Board transmitted to the parties the undated and unserved 1

' letter to it of Mr. Henry A. Stiner. That letter contains the sentence "Please consider this a request to become a party to the hearing in accordance to 10CFR," and thus might have been intended as an untimely' request for leave to intervene.

w If-the document was thus intended, the petition should be denied, on the grounds, inter alia, that it makes no attempt to demonstrate standing as required by

~ 10 C.F.R..$ 2.7142 and that it also makes no attempt to.

demonstrate that the requirements for late-filed petitions have been met. Boston Edison Co. (Pilgrim Nuclear Power Station), LBP-85-24, 22 NRC 97, 98, aff'd, ALAB-816, 22 NRC 461, 466 (1985).2 t It appears from Mr. Stiner's letter that his residence, at Horatio, Arkansas, is considerably more than 50 miles from the CPSES site.

2 To the extent that certain assertions contained in Mr. Stiner's letter might be construed to be-an attempt to establish " good cause" for late filing premised upon a misplaced reliance by him upon CASE to represent his interest, the attempt. fails as a matter of law. "A party or potential party cannot sit back and watch.the performance of another party (including the Staff), and then, if dissatisfied, be granted the right to come in late or have late-filed contentions accepted."
