PRELIMINARY NOTIFICATION OF EVENT OR UNUSUAL OCCUR'RENCE-PNO-77--84 This preliminary notification constitutes EARLY notice of an event of POSSIBLE safety or public interest significance. The information presented is as initially received without verification or evaluatio' n and is basically all that is known by IE staff on this date.

JUSTICE DEPARTMENT RESOLUTION OF NRC REFFERAL OF POTENTIAL CRIMINAL VIOLATIONS OF THE ATOMIC ENER9Y ACT OF 1954 In March 1976, NRC Region V became involved in an investigation revolving around the widespread removal of potentially radioactive items from the Nuclear Engineering Company Beatty Waste Disposal Site. The invest 1E a-tion disclosed numerous items of noncompliance with AEC/NRC regulaticras and license requirements. An order was issued by IE on March 11, 1917, immediately suspending NRC-licensed activities at the Beatty site per: ling further order. In May, the matter was referred by OIA to the Departe nt of Justice as a potential case involving criminal violation of the Atomic Energy Act.

Resolution of criminal referral occurred in a Federal District of Nemda Court, Reno, Nevada, on May 12, 1977, when Nuclear Engineering Compant pleaded nolo contendere to two criminal counts involviag violations of AEC/NRC regulations and the license. Nuclear Engineering paid a $10,000 fine as the penalty for the violations.

' Now that Department of Justice resolution of the criminal referral aspects has been accomplished, further action by NRC relative to the Suspension Order is under consideration by IE and NMSS.

No press release by NRC is planned; any inquiries roccived will be referred to the Department of Justieg.

NRC Region V received notification of this action by telephone call on May 12, 1977, from the NRC OIA representative present at the proceedings -.

and the Assistant U.S. Attorney involved in prosecuting the case.
