NRC STAFF MOTION TO STRIKE PORTION OF TESTIMONY OF GREGORY C. MINOR REGARDING THE EBS ISSUE The NRC Staff hereby moves to strike that part of the Direct Testimony of Charles G. Perry and Gregory C. Minor on Behalf of Suffolk County Regarding LILCO's Emergency Broadcast System (Minor Testimony) which is found on pages 13 and 14 of the Minor Testimony.
in his testimony, Mr. Minor states that the NRC regulations and guidance do not limit the requirement for dissemination of emergency inforniation to the EP2 population.
Mr. Minor is testifying to matters of law.
His testimony is in direct contradiction to this Licensing Board's Order of February 2ft, 1988 O, which specifically limits the EBS coverage requirement to persons within the 10-mile EPZ. Order at 3-4.
