SUBJECT:

ACCEPTANCE OF THE LONG-TERM SURVEILLANCE PLAN FOR THE SLICK ROCK, COLORADO, DISPOSAL SITE

Dear Mr. Rael:

The U.S. Nuclear Regulatory Commission (NRC) staff hereby accepts the U.S. Department of Energy (DOE) "Long-Term Surveillance Plan (LTSP) for the Burro Canyon Disposal Cell, Slick Rock, Colorado," dated May 1998. This action establishes the Slick Rock Burro Canyon disposal site under the general license in 10 CFR Part 40.27.

NRC staff commented on DOE's August 1997 draft LTSP for the Burro Canyon cellin a letter of

' January 27,1998, in response to NRC comments, DOE provided a revised LTSP, dated May 1998, which incorporates information requested by NRC and adds a commitment that rtandpipes at the disposal site will not be abandoned without prior NRC approval.

Therefore, the NRC staff has determined that the May 1998 LTSP satisfies the requirements set forth in the Uranium Mill Tailings Radiation Control Act of 1978 for long-term surveillance of a disposal site, and all requirements in 10 CFR Part 40.17 for an LTSP. In accordance with DOE's guidance documents for long-term surveillance, all further NRC/ DOE interaction on the long-term care of the Slick Rock Burro Canyon site will be conducted with DOE's Grand Junction Office.
