Dear Mr. Del Core:

I am responding to your letter of July 20,1998 in which you appealed the Nuclear Regulatory Commission 's (NRC) response dated July 6,1998, to your Freedom of Information Act (FOIA)

Request (FOIA 98-230) of June 4,1998. The agency's July 6,1998 response was labeled as a partial response, " Response Number 1," and not a final response to your June 4,1998 FOIA request in which you requested a list of names of Northeast Utilities (NU) managers that visited the Commissioners during 1997 and 1998. Although an appeal was premature, you noted in your Juiy 20,1998 appeal letter that no information had been provided to you for visits by NU officials to Dr. Jackson, Commissioner Diaz and Commissioner Rogers. The lists of visitors for Dr. Jackson and Commissioner Diaz are enclosed herein, which constitutes the agency's final response to FOIA 98-230. The NRC has not found any documents for visits by NU managers to Commissioner Rogers.

Acting on your appealletter, I have carefully reviewed the record in this case and have determined that all responsive information has now been provided to you in connection with your June 4,1998 FOIA Request 98-230. Moreover, although you indicated in your appeal letter that you now prefer copies of actual visitor logs, your FOlA request asked for a " list of names," not logs. Accordingly, the lists of names provided to you on July 6,1998 and attached herein, constitute a proper disposition of your FOIA request.

Finally, your June 4,1998 FOlA request noted that you fi!ed a previous fee waiver request and that you expect the waiver to continue. As I explained to you in my August 13,1998 response to your FOIA Appeal 98-015A (enclosed), since the previous fee waiver was denied (related to a FOIA request for Operational Safety Team inspection records), there is no fee waiver "to continue." I further explained on August 13,1998 with cited authorities that fee waiver requests are considered on a case-by-case basis and that the agency must evaluate each fee waiver regeest separately. Accordingly, although your June 4,1998 request to continue a previous fee waiwr is denied, please note that there are no fees associated with the agency responses to FOl/,98-230 because the minimum fee threshold of $20.00 was not reached.
