RESPONSE TO AUGUST 6,~ 1998, LETTER CONCERNING ASME BOILER AND PRESSURE VESSEL CODE

Dear Mr. Stevenson,

Thank you for your August 6,1998, letter and interest in the use of the ASME Boiler and Pressure Vessel Code in the construction of confinement and containment containers for the s' sue is storage currently beingand transportation evaluated of spent by the U.S. Nuclear fuelCommission Regulatory from commercial (NRC) nuclear reactors.

comments are appreciated.

As disc'ussed at the NRC/Nudear Energy Institute workshop on July 1- 1998, NRC's initiative is to fully utilize the goveming ASME Section lli Code, resulting in the ervices of an authorized nuclear inspector (ANI) in the fabrication shops and stamping of the 6onfinement and f

contain:aent containers. Your support of this initiative has been rWted.

However, the extension of this initiative to change the gover g Code to either fully or partially utilize ASME Section Vill is not in agreement with the curre standard review plans and historical precedent for the review of spent fuel storage co finements and transportation package containments. For NRC to fully evaluate this posal, a detailed comparison of the governing ASME Section til Code and proposed Sect Vi!! should be submitted along with your recommendation. Because the various section f the Code are written to be used as l whole units, it would not seem appropriate to combine parts from multiple sec+Jons.

Sincerely,/
