Dear Mr. Arthur:

By letter dated March 22, 1988, you requested NRC concurrence on DOE's decision to direct the State of Utah to acquire the area within the proposed final disposal boundary of the Green River processing site. The NRC's on-going review of the DOE preliminary Final Design and Remedial Action Plan has not identified to date any issue to preclude such an action. Therefore, pursuant to Paragraph 4.2.1 of Appendix A to the DOE /NRC flemorandum of Understanding and Section104(a)ofPublicLaw95-604,concurrenceisherebygiven. At the next opportunity DOE should modify the Cooperative Agreement to reflect this action and submit the modification to the NRC for signature.
