Dear Ms. Justin:

Your letter to the President dated July 29,1998, has recently been referred by the White House to the Nuclear Regulatory Commission (NRC) for response. In your letter, you expressed concern about the restart of Millstone Unit 3 and the performance of the NRC. As an

. independent regulatory agency, the NRC takes its responsibility for protecting public health and safety seriously.

Federal oversight of emergency planning for licensed nuclear power plants is shared by the NRC and the Federal Emergency Management Agency (FEMA) through a memorandum of understanding. The memorandum is responsive to the President's decision of December 7, 1979, that FEMA will take the lead in offsite planning and response, that NRC assist FEMA in carrying out this role, and the NRC's continuing statutory responsibility for the radiological health and safety of the public. As part of the NRC's Restart Assessment Plan for Millstone Uni! 3. the staff consulted with FEMA regarding the adequacy of offsite emergency planning associated with the Millstone facility. By letter dated May 18,1998, FEMA confirmed that there I

are no issues associated with offsite emergency planning that would preclude the restart of Millstone Unit 3. The decision by the NRC authorizing the restart of Millstone Unit 3 was made only after the NRC was satisfied that all restart related activities had been completed.

i The NRC has been intensively involved with the great number of issues surrounding Millstone l

for over 2% years. Starting early in the process, the public showed an active interest in all regulatory activities related to plant recovery and restart. In response, the NRC took extraordinary measures to assure that to the maximum extent possible regulatory business was i

I conducted in a manner that was open to public observation. The staff used input from local public interest groups such as the Citizens Regulatory Committee, the Citizens Awareness

)j Network, and the Connecticut Nuclear Energy Advisory Council (NEAC) to structure evening f

i meetings that provided an opportunity for the public to interact directly with the NRC staff and

/

comment on recovery and restart activities. These meetings were held at approximately 6 l.

week intervals. The staff also established and implemented avenues of communication that l

a!! owed the public to observe NRC activities and interact with the staff through public

l observation of (1) monthly meetings where third-party contractors presented the status of its independent corrective action verification program (ICAVP) review efforts to the NRC and the l

licensee, (2) meetings held between Little Harbor Consultants, NRC and the licensee to discuss status of the safety conscious work environment and employee concerns program activities, l

. and (3) all exit meetings of inspections conducted by the NRC inspection teams. The NRC staff made a concerted effort to hold the vast majority of meetings in the vicinity of the Millstone Station to make them accessible for public observation.

! The NEAC was invited to observe ICAVP implementation at the Millstone site as part of NRC's efforts to provide additional assurance of public participation in the oversight of the ICAVP. The State of Connecticut established the NEAC pursuant to Section 17 of Public Act 96-245. The NEAC is required to hold regular public meetings to discuss issues relating to the safety and operations of nuclear power plants, and to advise the governor, legislature, and municipalities within a 5-mile radius of the plants on these issues. Also, the NEAC is responsible to work with Federal, state, and local agencies, and the companies operating nuclear power plants to ensure public health and safety.

In meeting its responsibilities, the NEAC has invited and NRC representatives have attended, the regularly scheduled meetings of the.NEAC held on October 10,1996, February 20,1997, June 19,1997, July 17,1997, November 20,10

and May 14,1998, to discuss issues relating to the conduct of the ICAVP. In addition, the NRC staff kept designated NEAC members apprised of NRC's oversight of ICAVP activities.

In short, we are confident that the Commission's discharge of its statutory mandate, with the continuing scrutiny to which it is subject, is responsive to and in keeping with the high standards and expectations of the public.

Dear President Clinton,

CONPOSH is an umbrella organization for almost twenty neighborhoods in Sag Harbor. We work together to solve the many issues that affect our, lives and have had some successes that we hope will keep Sag Harbor the special place that is is.

We are sending you a small packet of information about an issue of great concern to the East End (of Long Island). Perhaps you are not mieu vi une operations or Northeast ~ Utilities' Millstone Reactors in Waterford, Conn. which in December of 1997 received the largest fine ever imposed by the Nuclear

Regulatory Commission because of safety and management violations.

Congressman Michael Forbes was not fully aware of the issues 1

Millstone Reactors posed for his consitutency ( us, here on the East End of Long Island) until we brought it to his attention at his Village Meeting here in Sag Harbor in March, 1998.

Since then he has 1) arranged for and held a public meeting on ss the North Shore on May 27th, the first ever held by the NRC for an area outside the state in which the Nuclear Facility at issue is based 2) demanded a delay of the reopening of the critical Nu_ clear Reactor #3 at Millstone until Long Isla @ ionyes were dealIsilth TEN 5'Jearmfry Impossible one of evacuat in the case of a Millstone accident). 3)after that delay was i

denied and after the Reactor #3 was reopened Forbes has arranged for j

meetings between the NU and town and county officials to address i

evacuation plans.

President Clinton, there is no possibility of evacuation of Long Island, as you will see this weekend when you will personally observe-the total West-East deadlock traffic. And there is certainly no poss-ibility of evacuation in the case of a nuclear catastrophe.

Our beautiful environment is already threatened i groundwater pollution from superfund sites (particularly from Brookhaven National Laboratories) and PLUTONIUM residues in the Peconic River which flows j

into our estuaries, other sources of serious air and water and soil degradation. The additional risk from the operation of badly run Millstone Reactors is more than our vulnerable environment can w

tolerate low level radiation on a continual basis ( low level rad-lation affects molecular growth in developing tissue in children and adolescents); toxic dumping into Long Island Sound, and the possibility of catastrophe from even a saml1 nuclear accident OR total catastrophe from a nuclear meltdown.

I am enclosing information to bring you up to date on this threat.

l As you will see, there is a MILLSTONE PROTEST planned for August 1st l

during your stay here on the East End.

It will take place between 4PM and 7PM on Saturday, August lat at the HOOK MILL GREEN in East Hampton. You can easily pass that way on the trip between your af ternoon date in East Hampton and the Democratic Fund Raiser in Amagansett.

As you pass by, the people there will be thrilled to see you in the hope that you will read the messages on their placards and the messages on their faces (and on the faces of the many teenage cancer sufferers).

The behavior of the Nuclear Regulatory Commission toward Northeast Utilities and Millstone Reactors has shown the NRC's disregard of the public it was charged to protect. There is a need for a thorough reorganization of Nuclear Regulatory Oversight. We hope you will initiate this reorganization.

A friend who travels in Turkey visited a lovely village near the Mediterranean Coast. Named Kuruderra, it was unspoiled, full of traditional charm. Chatting with residents (peasants) he heard that a few weeks before had been threatened by a mining company's drive to put a r'ad through its center.

The Turkish Army arrived to support the digging of the road. The village women and men decided to do something quite out of character with peasant life - they decided to resist and they did i women in the front brandished pots and pans, clanking the lids togetner as they stood their ground at the groundbreaking.. men followed raising hoes and forks and other farm implements and tools. The troops in their full riot gear were confronted. The army troops stood aside.

The mining company's men retreated.

Now a neighboring village further into the mountains has a road running through its center, it has been torn apart. Kuruderra is still a postcard village with happy residents; the other village will be noisy and ugly. It has a disgruntled population. Which village do you think attracts travellers and vacationers?

Our lovely once unspoiled East End is at such a crossroads. If we do not brandish our pots and pans and raise our tools, the risks piling up against our environment will destroy the fabric of our lives.

We must not accept any more. We must fight - we must fight to shut down the Millstone Reactors for good. We must fight until Northeast Utilities is forced to decommission.(On July 18th Northeast Utilities DID announce they will not go ahead on restarting Reactor #1).

We can do it. We have everything on our side; political representatives who we hope will stand up for our needs, a strong press and a powerful population waiting to be heard.

Dear Congressman Forbes,

We understand that the meeting on July 20th to discuss an emergency evacuation plan excludes the public and the press.

It is our view that if the public cannot participate it should be allowed to observe all such meetings. Considering the disregard of public welfare and opinion in Long Island by the NRC and the blatant disobservence of certain emergency planning regulations by Northeast Utilities, the public must be included from the beginning of this next step. There should be no secret meetings, no secret plans.

You, our elected representatives should not make Northeast Utilities a partner in planning for your constituents. Their lack of concern for Connecticut Citizens certainly sends us a message of extreme caution in their dealings with Long Islanders. We are uneasy that power (in more respects than one) politics might once again overlook those most affected, namely every man, woman and child living on Long Island.

Thank you for your past concerns in this matter. Please do not take a wrong turn now.
