I approve the staff reconrnendations for simplification and abbreviation of the rulemaking process associated with issuing certificates of compliance for spent fuel storage and transportation casks.
I commend the staff for reviewing its current processes and identifying an area where efficiencies can be gained and resources can be saved for both NRC and its licensees with no impact on public health and safety.

SUBJECT:
SIMPLIFICATION OF THE RULEMAKING PROCESS FOR CERTIFICATE OF COMPLIANCE RULEMAKINGS The Commission has approved the staff's proposals for simplifying the rulemaking process for certificate of compliance rulemakings for listing storage casks in 10 CFR 72.214. The staff should seek public comments in the Federal Reaister notice on the first rulemaking regarding its proposal to begin using the direct final rule process for rulemakings of this type. If no negative comments are received on this approach, the staff should begin using the direct final rule j
approach without waiting for two rulemakings as noted in SECY-98-188.
