Good afternoon, ladies and 3

gentlemen.

4 This is an affirmation, possible discussion session 5

on items for affirmation.

I will ask the Secretary to lead us 6

through the three items on the agenda.

7 MR. CHILK:

The first one is SECY 85-386, the 8

subject "60 Minutes Broadcast on Shoreham Construction."

In 9

this paper the Commission is being asked to respond to a March 10 27th, 1985 Suffolk County, New York State motion for an 11 immediate investigation of issues raised during a March 24, 12 1985 CBS broadcast of "60 Minutes," and for the Commission to 13 hold in abeyance all Commission proceedings on the Shoreham 14 licensing and operation pending completion of the 15 investigation.

16 Chairman Palladino, Commissioners Roberts, Bernthal 17 and Zech have approved an order with modifications proposed by la Chairman Palladino and Commissioner Zech which denies both 19 portions of the motion.

20 Commissioner Asselstine disapproves, indicating he 21 would have preferred to treat the motion for investigation as 82 a 2206 petition and refer it to the Staff.

83 The Commission also agreed that a summary report for 84 the Commission from EDO on the alleged construction problems 85 should be served on the party.

I have two other items, Mr. Chairman, 4

and they both require a vote to hold on short notice, and I 5

wonder if I can have that on SECY 86-25 and SECY 86-27; 25 6

dealing with Shoreham, and 27 dealing with Waterford.

SECY 86-25, Intervenor's Motion for 10 Cancellation of the Shoreham Emergency Planning Exercise.

The 11 Commission in this paper was asked to respond to a motion by 12 New York State and Suffolk County and the town of Southhampton 13 requesting the Commission cancel emergency planning exercise 14 for Shoreham scheduled for February 13th, 1986.

J 15 Commissioners Bernthal, Roberts and Zech have 16 approved the order which denies a request for cancellation of 17 the exercise.

i 18 Chairman Palladino and Commissioner Asselstine have 19 disapproved the order.

Chairman Palladino has provided 20 dissenting views which are attached, with which Commissioner 21 Asselstine agrees.

The order will also have additional views 22 by the majority.

10 asked to act on an order responding to ALAB-812 and the 11 request by the Joint Intervenors to open the Waterford 12 proceeding on issues that may relate to matters under 13 investigation by OI.-

14 Commissioners Zech, Roberts and Bernthal have j

15 approved the order, denying the request to reopen, as modified i

16 by the General Counsel and by commissioner Bernthal's l

17 comments.
